On this date the Board of Supervisors considered the adoption of an Ordinance (Introduced April 19, 1994) prohibiting tripping and tailing events and requiring the presence of a veterinarian at rodeos . Chairman Powers recognized the following persons to present testimony: Jeffrey Kerwin, 2030 Addison Street, 7th Floor, Berkeley, representing the Federacion De Charros, spoke in opposition to the ordinance and presented a letter from Ann Marie Buonanno, D.V.M. Mark Franco, 17200 Kelso Road, Byron, representing the Mexican Federation of Charros, presented a letter from Larry Gosselin, D.V.M. , North State Equine Veterinary Hospital, in opposition to elimination of certain Mexican Rodeo events, and he requested that the Board reconsider the ordinance . Jesus Castellanos, 5321 Hopyard Road, Pleasanton, President of the Mexican Federacion of Charros, spoke in opposition to the ordinance . Henry Franco, 1342 Rutherford Lane, Oakley, spoke in opposition to the ordinance . Mark Franco, Jr. , 7820 Vallecitos Road, Sunol, spoke in opposition to the ordinance. Jose A. Navarro, 931 J Street #75, Davis, urged the Board to take an objective view of the ordinance and see both sides equally. Abraham Amador, 11 Amador Avenue, Oakley, urged the Board to give serious and conscientious consideration to the issue . Chairman Powers read a card from Chris Baldwin, P.O. Box 1378, Antioch, who did not wish to speak unless there was a desire by the Board to modify the ordinance. Supervisor Torlakson requested clarification on when the ordinance would go into effect . Victor Westman, County Counsel, responded that it would be in thirty days . Supervisor Torlakson suggested that the ordinance be adopted today, but requested that the Animal Services Department review the information brought forward today and alert the Board if, after reviewing the facts, they have grounds to change their recommendation to the Board. IT IS BY THE BOARD ORDERED that Ordinance No. 94-43 is ADOPTED; and the issues raised at the Board meeting this day pertinent to this Ordinance are REFERRED to the Animal Services Director for report to the Board on May 24 , 1994 . I have been an. equine veterinarian for thirteen years. My practice encompasses all segments of the equine performance industry. I have performed veterinary. services at your rodeo . facility throughout this period. : My experience has been that the incidence of serious injury at your facility has. not exceeded that found with other equine performance ventures. I have reviewed the videotape of the story produced by "Hard Copy" and have found the depictions to be' inflammatory and probably inaccurate. Although the scenes depicted are distressing it is important to view the tape with the realization that these events are conducted to minimize injury to the horses. My opinion is that much more can be accomplished for the benefit of the horses, the animal rights movement, and the Hispanic equestrian community through a cooperative effort to minimize injury by. addressing necessary changes in arena footing and rules of competition, than by an elimination of . this important aspect of your culture. I share your concern regarding this matter. Although my schedule is very busy, I would be willing to review this event with you and a. member of the animal rights community to discuss possible changes to further' minimize risk to horses. During this time, none of the animals used for the various events, cattle or horses, have been injured. While I have mixed personal feelings about the horse roping event, I can say that none of the horses have been hurt at this particular rodeo while I've been present. If the horse's legs are roped, the horse usually falls slowly to its knees or on its side or the horse doesn't fall at all. This particular arena is sandy and fairly soft. I have not seen any lame or injured horses used for this event. The horses are usually lean and muscular, but not terribly underweight or malnourished. The Franco's and I have discussed this particular event, and they are willing to work with me or any other veterinarian present to make sure the animals are not overworked or stressed, that the arena is kept soft, and that no lame or injured horses are used for the event. I have not been to any other Mexican rodeos, so I can only state what I have observed at this one. If you have any questions for me, I can be reached at 510-449-1867. SECTION I. Division 417, Chapter 417-2 is added to the Contra Costa County Ordinance Code to read: Division 417 Rodeos. Chapter 417-2 Rodeo Events. Article 417-2 Definitions. 417-2.002 Rodeo. As used in this chapter, "rodeo" means a public event or competition of the skills of cowboys or cowgirls, including, but not limited to such events as: bareback riding, saddle bronc riding, bull riding, calf roping, steer wrestling, team roping, steer roping, and barrel racing. (Ord. 94- 43 . ) Article 417-2.2 Rodeo events or other activities prohibited. 417-2.202 Equine Animals. No person shall intentionally trip or fell any equine animal (including but not limited to, any horse, mare, pony, ass, donkey, burro, mule, or hinny) by the legs by any means whatsoever for the purpose of entertainment, sport or practice, including a rodeo. No person shall intentionally promote, conduct, or hold, or supply livestock for any entertainment, sport or practice, including a rodeo, where any person intentionally trips or fells any equine animal by the legs by any means whatsoever. (Ord. 94- 43 . ) 417-2.204 Bovine Animals. No person shall intentionally trip, drag or fell any bovine animal (including but not limited to, any steer, calf, bull, ox, heifer or cow) by the tail by any means whatsoever for the purpose of entertainment, sport or practice, including a rodeo. No person shall intentionally promote, conduct, or hold, or supply livestock for any entertainment, sport or practice, including a rodeo where any person intentionally trips, drags, or fells any bovine animal by the tail. by any means whatsoever.. (Ord. 94- 43 . ) Article 417-2.4 Rodeo Veterinarian. 417-2.402 Veterinarian. Any person promoting, conducting or holding a rodeo shall have a veterinarian in attendance (physically present) throughout the duration of every event using animals, except for "youth" or "high school" rodeos where participants are minors. (Ord. 94- 43 .) 417-2.404 Qualifications. The veterinarian in attendance shall be licensed by the State of California and shall be experienced in the treatment of the types of animals used in the animal events. (Ord. 94- 43 , ) 94-43 -2- 417-2.406 Non-contestant. The veterinarian in attendance shall not be a. contestant or otherwise participate in any animal events. (Ord. 94- 43 . ) Article 417-2.6 Violations. 417-2.602 Violation. Any violation of any provision of this chapter is a misdemeanor. (Ord. 94- 43 § 14-8.004(b) ; Gov't. Code § 25132(a) . ) SECTION II. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days of passage shall be published once with the names of the Supervisors voting for and against it in the CONTRA COSTA TIMES a newspaper published in this County.
