SPSCIFIC AEOUESTIB)OR RECOMMENDATION(81 i BACKGROUND AND JUSTIFICATION
RECORDATION:
(1 ) Adopt resolution establishing the Byron Municipal
Advisory Council in accordance with guidelines .adopted by
the Board of Supervisors in November 19831 for the
establishment of municipal advisory councils .
( 2) Authorize the District V Supervisor to initiate
the recruitment and interview process for potential Council
candidates . Upon completion of this process, the District V
Supervisor will provide appointment recommendations for
formal approval by the Board of ;Supervisors .
BAMROUND ss
In the Syron community a group of concerned individuals
active in the local town have formed a group currently known
as the Byron Advisory Council . This group is now interested
in transitioning to a more official form of representation
as a municipal advisory council.
The formation of a MAC for the Byron community will
allow community members to expand on their efforts to
continue working cooperatively with Contra Costa County and
its neighboring communities to plan for the future of the
area ,
The Council would serve solely in an advisory capacity.
The Council will serve without compensation of any kind, and
Contra Costa County will not provide any funding for council
(stipends, council member' s expenses, or other Council
operating costs. Although County staff will provide the
Council with information and reports related to the
Knightsen area, the Board will provide no ongoing
professional or clerical staff support to the Council .

hereby RESOLVED by- the Board of Supervisors that:

Tba Council shall consist of seven (7) members 'who
i�iall be residents of the Byron community (as described
1,h Item 3 below) . The initial body of Council memlaers
hall be appointed by the Board of Supervisors of
Contra Costa County upon the recommendation of the
District V Supervisor.
3 . BySon ommunity
Th# Byrom Community is that area contained within the
.bPVndaries indicated on the attached map (Exhibit A) .

For the initial council the Board shall, by lot, selebt
four (4) members who shall serve an initial term. of
four (4 ) years and three (3) members who shall serve. an
initial term of two (2) years. Upon completion : -of
ii%%Itial terms, subsequent council members shall serve
fr:?u.r (4 ) year (staggered) terms.

,.slid use 'and planning matters affecting the community
ai: Byron .and may, represent the Byron community before
the Board of Supervisors, the Bast County Regional
F.16nning Commission and the Zoning Administrator ; on
such issues as land use, planning and zot%Lhg. the
Council may also; represent the Byron Community before
the Local Agency Formation Commission on proposed
boundary changes ;affecting the community.
Th;e Council may Advise the Board on services :which are
or may be provided to the Byron Community ''by' Contra
Cbsta County or other local governmental agencies.
Such services include, but are not limited to, public
health, safety, welfare, public works, and planni:og.
The Council may also provide input and reports to the
Board of Supervisors, County Staff or #ny County
hoaring body on issues of concern to the Byron
cOT1Em nity.
it is understood that Council members serve in an
advisory capacity only and that the Board of
Supervisors is the final decision making authority with
respect to issues concerning the Byron Community. The
Council will not attempt to represent a County position
to any outside agency and will make clear to :any such
agency its position of service as an advisory body
only.
6 . �ipgnsation ,
Council members will serve without compensation of any
kind. Contra Costa County will not provide funding for
the payment of meeting stipends or any expenses
incurred by the Council.
7. Lt_aff and Financial Suvcort
A. Contra Costa County shall provide no ongoing
professional or clerical . staff support to the Byron
Municipal Advisory Council, nor will the County provide
any funding for the Council's operating costs .
B. County staff will provide the Council in a timely i
manner with information and reports on planning matters
(proposed General Plan and zoning changes, land use
permits, variance and subdivision applications, etc.),
transportation issues or projects, or any such matters
which take place in, or will have an effect on, the
Byron Community. LAFCO staff will notify the Council
of any proposed boundary or sphere changes which may
impact the Byron community.
B. Ctmncil eration
Within the paraneters of this resolution, the Byron
Municipal Advisory Council may organize itself and
operate as it determines, but shall hold regular
meetings at least monthly at an established time and
location. Any such meeting may be adjourned to :the
next regular monthly meeting if there is no business to
be transacted at that time. The Council's meetings
shall be conducted in accordance with the provisions of
the Brown Act (Government Code Sectons 54950 ff,. ),
including the posting of meeting agendas . The Council
will. adopt bylaws (using the County's recently adopted ;
standard MAC bylaws as a foundation) and will provide a
copy of said bylaws to the office of the District v
Supervisor.
9 . ouncil Establishment Not Subject to Vote
The issue of the establishment of the Byron Municipal
Advisory Council shall not be an election item
submitted to the voters of the Byron Community.
10. 1ho t4re Elections
The Community has requested an appointed Council at
this time. However, the Community intends to
transition to an elected body at such time as funds for
an election become available. Any costs incurred as a
result of such an election will be the r"possibility
of the Byron Community and will not be borne by Contra
'Costa County.
11 . Dissolution of Qmcil
-The provisions of this resolution shall be of no
further force and affect after .;une 1, 1998 and the
Council will be dissolved on that date unless the Board
of Supervisors has taken action to extend the Council's
oxiztence.
