On April.19 , 1994, the Board held hearings on the said General Plan Amendment discussed by the East County Regional Planning Commission, Resolution 15-1994. Notice of said hearing was duly given in the manner required by law. The Board, at the hearings, called for testimony of all persons interested in this matter. After taking testimony, the Board closed the public hearing and APPROVED the General Plan Amendment and directed staff to included the Hofmann General Plan Amendment in one of the consolidated general plan amendments as allowed by State Planning Law. Open public hearing and receive testimony on proposed plan amendment request. 2. Certify as adequate the Negative Declaration on this project for purposes of acting on the General Plan Amendment. 3. Close the public hearing and either: (a) If the Board be so inclined, uphold the East County Regional Planning Commission's recommendation to DENY the general plan amendment request; or (b) based on staffs recommendation, APPROVE the General Plan Amendment and direct staff to include it in one of the consolidated general plan amendments for 1994. FISCAL IMPACT The applicant has paid a general plan amendment fee. BACKGROUND/REASONS FOR RECOMMENDATIONS This plan amendment involves a land use change which would result in a loss of about 12 acres of property which is presently designated under the Commercial land use designation. The proposed land use change would accommodate 81 residential units under the Multiple Family Residential - Low Density designation (10.6 acres). About one acre in the plan amendment area would be retained under the Commercial designation and another acre would be designat or OfflVe. Staff Contact: Matt Tomas (6-2036) April 19, 1994 Orig: Community Development Department ATTESTED cc: Deputy, Cl k of the Board (L CAO's Dept. of Public Works OMAC AJ. 0 I Report on Hofmann General Plan Amendment Continued - page 2 BACKCROUND/REASONS FOR RECOMMENDATION On a 3-1 vote, the East County Regional Planning Commission recommends DENIAL of the proposed general plan change because of concerns that the loss of commercial acreage may be premature and given future residential development in Oakley, that this particular site will be needed for commercial-related uses. County planning staff is recommending APPROVAL based on the amount on developable acreage in Oakley which is presently designated under the Commercial land use desingation. Staff estimates that there is about 185 acres available for commercial use, which could support up to 2.3 million square feet of commercial development. The loss of 10.6 acres acounts for about 7 percent of the total potential commercial, square footage and is not considered to be a significant loss. Market studies, which have been prepared for the Oakley Specific Plan effort, imply that even with planned residential growth for year 2010 and beyond that there may be too much acreage under the Commercial land use category. Parallel Land Development Applications - At the time this general plan amendment was heard by the East County Regional Planning Commission, there were parallel land development entitlements which were also scheduled for public hearing. Because the Commission is recommending denial, it was agreed that the public hearings for the land development entitlements would be continued to the Commission's May 1994 meeting in the hope that the Board of Supervisors could make a decision in a timely manner. �I ADDENDUM TO ITEM H.7 APRIL 19, 1994 This is the time noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the East County Regional Planning Commission on the request by Hofmann Company (applicant) and Kenneth and Martha Hofmann(owners) for a General Plan Amendment (6-93-EC)to change the County General Plan land use designation from Commercial to a split designation of Commercial (1.40 acres) and Multiple Family Residential,Low Density(10.7 acres), in the Oakley area. Dennis Barry, Community Development Department, presented the staff report on the General Plan Amendment request, describing the proposed site and changes, and commented on the small office portion recommended on the southern portion of the site. Mr. Barry also commented on the recommendation for denial from the East County Regional Planning Commission and on the staff recommendations as presented. Supervisor Torlakson requested clarification of the position of the Oakley Municipal Advisory Council (GMAC), and on the vote of the East County Regional Planning Commission. Mr. Barry commented that OMAC against the amendment and that the vote of the Planning Commission was 3-1 to deny the amendment. Victor Westman, County Counsel, advised that the Commission's action was only a recommendation to the Board. The following person presented testimony: David Lennon, 1380 Galaxy Way, Concord, representing the Hofmann Company, commented on leaving the staff proposed office designation in commercial and presented revised language for the General Plan amendment; Julie Linder, resident on property to the south of Almond Tree Lane, expressed concerns with the zoning for the southern portion of the site; Jonathan Laturi, 900 Almond Drive, Oakley, spoke in opposition to the proposed amendment and presented written comments. David Lennon spoke in rebuttal. The public hearing was closed and the matter was before the Board. The Board discussed the matter. Supervisor Torlakson expressed concurrence with the General Plan Amendment request and leaving the small southern portion zoned as it is and he moved approval of the staff recommendation and the deletion of the language on the designation of the southern portion. Supervisor Smith seconded the motion. IT IS BY THE BOARD ORDERED that recommendations 1,2, and 3B are APPROVED; and Resolution 94/247 determining to amend the General Plan is ADOPTED.
