SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation as prepared for this project as being adequate. 2 . Approve Rezoning #2986-RZ and Development Plan #3007-92 with the conditions as modified by the East County Regional Planning Commission at the February 7, 1994 hearing. 3 . Approve the findings contained in the Resolution #10-1994 of the East County Regional Planning Commission as the basis for the Board's action. 4. Introduce the ordinance giving effect to the Rezoning #2986- RZ, waive reading and set date for adoption of same. 5. Direct staff to file a Notice of Determination with the County Clerk. FISCAL IMPACT None. The Commission after taking testimony voted unanimously to approve Subdivision #7760 and recommend approval of #2986-RZ and #3007-92 to the Board of Supervisors. ADDENDUM TO H.5 APRIL 19, 1994 On April 12, 1994, the Board of Supervisors continued to this date the hearing on the recommendation of the East County Regional Planning commission on the request by Bellecci and Associates (applicant) and North State Development(owner)to rezone 15.3 acres of land from General Agricultural District (A-2) to Planned Unit District(P-1) (2986-RZ), for approval of a final development plan to develop the site with 85 single family residential lots (DP 3007-92), and for approval of a vesting tentative map to subdivide the 15.3 acre site into 85 residential lots in the Oakley area. Dennis Barry, Community Development Department, presented the staff report on the proposal. The following person presented testimony: Richard Sestero, representing North State Development, commented on the compromises that had been reached with the neighbors and on the masonry wall that would be placed along the south boundary, and the improvements along Tate Lane and the masonry wall on Tate Lane. Mr. Sestero advised of requested modifications to conditions of approval for Amberwood 2 and Amberwood 8 as attached. The Board discussed the matter. Mitch Avalon, Public Works Department, presented a modified condition 20h.1, last sentence of first paragraph to read: Satisfaction of this condition shall include the installation of line B4, a portion of line B and the completion of a portion of Basin No. 2 of Drainage Area 29H Plan, if the Basin extension is needed for storage capacity or for the early development of the watershed and to the satisfaction of the Flood Control District. The public hearing was closed. Supervisor Torlakson commended all the parties that had worked together on this proposal and he moved approval of the project with amended conditions. IT IS BY THE BOARD ORDERED that the staff recommendations 1, 2 with amended conditions, 3, 4, and 5 are APPROVED; and Ordinance No. 94-29, giving effect to the rezoning, is INTRODUCED, reading waived, and April 26, 1994, is set for adoption of same. Modified Conditions of Approval Subdivision 7760, Rezoning 2986-RZ Amberwood 8 I. This application is approved for up to 91 residential units subject to a revised Tentative Map dated received November 18, 1993 being submitted for review and approval of the Zoning Administrator with the following modifications: A. The maximum number of approved lots is 91. Two lots along Tate Lane shall be eliminated and relocated elsewhere,in the subdivision subject to review and approval of the Zoning Administrator. 75 percent of residences backing up to Tate Lane shall be one story only. 16-G Fence design and location shall be shown on landscaped plans. The fencing shall be designed to stand up in the sandy soil of the site by use of suitably spaced cement pilasters, wood and metal poles, pressure treated cement encased poles, or some other method acceptable to the Zoning Administrator. Fencing shall be established along all sides of the site that do not front upon streets. The northerly property line of the site shall be fenced with a precast concrete or masonry wall at the developer's option. 21. Delete. See Advisory Note D. ambwd8\tatelane
