SUBJECT: Consider introduction of proposed ordinance: banning certain rodeo events
and requiring that a veterinarian be present at rodeo events.
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
1. Accept report from the Animal Services Director, introduce the attached
proposed ordinance banning certain rodeo events and requiring that a
veterinarian be present at rodeo events, waive reading, and fix April 26,
1994, for adoption.
II. FINANCIAL IMPACT:
1. The investigation of any alleged violations of the ordinance and any
subsequent prosecution could entail the utilization of Animal Services
Department, District Attorney and Sheriff personnel and resources.
Anticipated enforcement activity is expected to be very low or
nonexistent. Therefore, allocation of additional funds to enforce this
ordinance should not be necessary.
2. The requirement that a veterinarian be present at rodeo events should not
result in the expenditure of additional County funds in that this expense
will be borne by the event organizer.
III. BACKGROUND:
1. The attached proposed draft ordinance would ban two specific rodeo events
and require veterinary presence at rodeos. "Tripping" - the lassoing
and tripping of running horses by their legs to fell them, putting the
horses at risk of serious injury or even death; and the
grabbing of the tail of steers to fell them.
2. Neither of these events are included in Standard American Rodeos.

3. "Tripping" and "Tailing" have recently been banned in Alameda County.
4. At present, the Contra Costa County Animal Services Department is not
aware of this activity in Contra Costa County, however, there is concern
that proponents of these events may look for sites in Contra Costa County.

5. Rodeo events involve the utilization of animals in various forms of
competition that may be strenuous and pose the risk of possible injury to
the Animals involved. Certain injuries are life threatening and require
the immediate attention of a veterinarian if the animal is to be saved or
must be humanely eutbanized.
6. There is broad support for this proposed ordinance. The Animal Services
Department has received over two-hundred letters of support, half from
Contra Costa County residents.

ORDINANCE NO. 94-
(Prohibiting "Tripping" and "Tailing" events at rodeos
and requiring presence of veterinarian at rodeos)
The Contra Costa County Board of Supervisors ordains as follows (omitting the
parenthetical footnotes from the official text of the County Ordinance Code) .
SECTION I. Division 417, Chapter 417-2 is added to the Contra Costa County
Ordinance Code to read:
Division 417 Rodeos.
Chapter 417-2 Rodeo Events.
Article 417-2 Definitions.
417-2.002 Rodeo. As used in this chapter, "rodeo" means a public event or
competition of the skills of cowboys or cowgirls, including, but not limited to
such events as: bareback riding, saddle bronc riding, bull riding, calf roping,
steer wrestling, team roping, steer roping, and barrel racing.

Article 417-2.2 Rodeo events or other activities prohibited.
417-2.202 Equine Animals. No person shall intentionally trip or fell any
equine animal (including but not limited to, any horse, mare, pony, ass, donkey,
burro, mule, or hinny) by the legs by any means whatsoever for the purpose of
entertainment, sport or practice, including a rodeo. No person shall
intentionally promote, conduct, or hold, or supply livestock for any
entertainment, sport or practice, including a rodeo, where any person
intentionally trips or fells any equine animal by the legs by any means whatsoever.

417-2.204 Bovine Animals. No person shall intentionally trip, drag or fell
any bovine animal (including but not limited to, any steer, calf, bull, ox, heifer
or cow) by the tail by any means whatsoever for the purpose of entertainment,
sport or practice, including a rodeo. No person shall intentionally promote,
conduct, or hold, or supply livestock for any entertainment, sport or practice,
including a rodeo where any person intentionally trips, drags, or fells any bovine
animal by the tail by any means whatsoever.

Article 417-2.4 Rodeo Veterinarian.
417-2.402 Veterinarian. Any person promoting, conducting or holding a rodeo
shall have a veterinarian in attendance (physically present) throughout the
duration of every event using animals, except for "youth" or "high school" rodeos
where participants are minors.

417-2.404 Qualifications. The veterinarian in attendance shall be licensed
by the State of California and shall be experienced in the treatment of the types
of animals used in the animal events.

417-2.406 Non-contestant. The veterinarian in attendance shall not be a
contestant or otherwise participate in any animal events.

Article 417-2.6 Violations.
417-2.602 Violation. Any violation of any provision of this chapter is a
misdemeanor.

SECTION II. EFFECTIVE DATE. This ordinance becomes effective 30 days after
passage, and within 15 days of passage shall be published once with the names of
the Supervisors voting for and against it in the , a
newspaper published in this County.
