Dear President:
Attached are copies of two (2)letters that the County has issued directing the HOMEOWNER
and BLACKHAWK HOMEOWNERS ASSOCIATION to REMOVE the ILLEGAL FENCE_ in
the common area behind our homes on Blue Spruce Drive.
As a County resident and property owner since 1970, I'm appealing to you to take some action on
this problem. When I purchased my home on Blue Spruce in 1985, I was told that the common
area would ALWAYS REMAIN OPEN AND NOTHING WOULD BE PLACED IN THAT
AREA. Your Board approved the Development Plan.
It seems very simple to me. The existing law has been violated and therefore the fence should
have been removed on July 12, 1993. I sincerely hope that the Board of Supervisors is not going
to allow Homeowners Associations to OVERRIDE approved zoning laws.
Please honor my (and my neighbors) request and enforce the law. Please have the fence
removed.

This letter is in response to your letter of July 12, 1993 regarding the use of a portion of a
common area parcel by an individual property owner in the Blackhawk subdivision. The
property owner, Mr. Angelo Paradiso, lives at 676 Blue Spruce Drive.
Subdivision 5440 was the subdivision which created the parcels in the Blue Spruce area and
identified the parcel of land (1 .12 ac/Pcl G) which is located to the rear of the #676 Blue
Spruce to #724 Blue Spruce as a "Common Area".
It is our belief that the use of the common area was limited by the CC & Rs and development
rights were granted to the County. Any development of such parcels, including fencing,
requires approval by the Board of Supervisors. It is the responsibility of the underlying
property owner to make a request to the County. With this letter we are requesting that you
take action immediately to remedy this situation.
An attorney representing your association contacted me several months ago but never
followed up. For that reason, I am contacting you again on this issue.

Dear Property Owner,
Information has been received that the open space in the rear of
676 Blue spruce Drive, Danville, CA, is in the process of being
developed by the installation of a fence and the creation of a
landscape easement.
The parcel is designated as a common area parcel for open space and
recreational facilities and was developed as such under P-1
Development Plan 3035-78.
Any change in the use of this common area requires an amendment of
this Development Plan.
Please remove any fence or development on this parcel within 10
days after receipt of this letter.
If you wish to request an amendment to Development Plan 3035-78,
please contact the Community Development Department at 646-1600 and
make application for a .modification of this existing Development
Plan.
