RECOMMENDATION A. APPROVE the Seventh Amendment of the Consulting Services Agreement with Kaplan/McLaughlin/Diaz, and AUTHORIZE the County Administrator or his designee to execute the Amendment which will be effective April 12, 1994. B. AUTHORIZE the County Administrator or his designee to issue written authorization for extra work, provided that the cumulative total extra cost for all such authorization shall not exceed $25, 000. 00. II. FINANCIAL IMPACT • Funds in the capital account established for the project are sufficient to cover the amount encumbered by this agreement, from bond proceeds specified to the project. Bond financing for the total project cost was secured in May, 1992 in accordance with the Board of Supervisors direction. REASONS FOR RECOMMENDATIONS On March 3, 1992 , the County entered into an agreement with the project architect, Kaplan/McLaughlin/Diaz, to provide the Design Development and Construction Documents for the proposed replacement County Hospital in Martinez. After executing the original agreement, six amendments were made for extra services, they are as follows: Amendment No. 1 - provide the services of a Communications Consultant; Amendment No. 2 - provide the services of a Radiation Physicist; Amendment No. 3 - provide the services of a Sign and Graphic Consultant, provide Consultant for the development of Division 11 Equipment Specifications, attend the value engineering workshop, and revise documents in accordance with recommendations of value engineering workshop; Amendment No. 4 - revise documents to reflect selection of communication "Combined Option B" ; Amendment No. 5 - provide the services of a Security Consultant; and Amendment No. 6 - correct unforeseen conditions, provide design drawings and specifications for the cable television, revise Bid Package 3 documents to incorporate new design information, revisions to surgery department, emergency department, and crisis center, and prepare an exterior rendering for the new hospital. Construction of the replacement hospital has been broken down into three separate bid packages, the final plans for each bid package has been submitted to the Office of Statewide Health Planning and Development for review. Final approval from the State for the plans for Bid Package 1 was received on May 26, 1993 and the Board directed that bids be received for this work on July 8, 1993 . Final approval from the State for BP2 was received on July 28, 1993 and the Board directed that bids be received for this work on September 9, 1993 . Approval from the State for Bid Package 3 is still pending. For the project to proceed without delay or discontinuity in services and to comply with OSHPD requirements it is necessary to amend the Consulting Services Agreement and approve six (6) extra work proposals noted as follows: 1 - perform field investigation work and preparation of documents to correct unforeseen conditions during the construction of Bid Package Nos. 1, 2, and 3 ; 2 - provide design drawings and specifications for the cable television; 3 - revise Bid Package 3 documents to incorporate new design information; 4 - revise Bid Package 3 documents to include the additional outlets; 5 - remove the special-use-area classification in the surgery department, emergency department, and crisis center; 6 - prepare an exterior rendering of the new hospital; and 7 - revise Bid Package 2 documents to include the additional underground electrical work. Approval of this amendment will increase the payment limit from $4, 109, 011. 00 to $4, 228, 915. 00. EFFECTIVE DATE AND PARTIES Effective on December 20, 1993, Kaplan/McLaughlin/Diaz, a California corporation (hereinafter called "Consultant") , and the County of Contra Costa, a political subdivision of the State of California (hereinafter called "Public Agency") mutually agree as follows: 2. PURPOSE Effective March 3, 1992, the parties entered into a written contract entitled "Consulting Services Agreement" (referred to as the "Agreement") , which covered architectural services for a replacement hospital at 2500 Alhambra Avenue, Martinez. The Agreement has previously been amended as follows: Amendment No. 1 dated December 8, 1992; Amendment No. 2 dated December 14, 1992; Amendment No. 3 dated December 16, 1992; Amendment No. 4 dated April 6, 1993; Amendment No. 5 dated April 29, 1993; and Amendment No. 6 dated June 9, 1993. The County desires to further amend the Agreement to expand the scope of services, and to revise the payment limit accordingly. 3. AMENDMENTS TO AGREEMENT A. In the Agreement, Section 1(e) , change the payment limit from $4,109,011.00 to $4,228,915.00, an increase of $119,904.00. B. In Appendix B, Paragraph D.3, add the following: Amend. Perform field investigation work and preparation of documents to correct unforeseen conditions during the construction phase of Bid Package 1, 2, and 3 as described in Extra Work Proposal No. 14 dated 12-20-93. $25,000.00 r. Provide design drawings and specifi- cations for the cable television as described in Extra Work Proposal No. 15 dated 12-21-93. $14,151.00 S. Revise Bid Package 3 documents to incorporate new design information as described in Extra Work Proposal No. 17 dated 2-23-94. $24,733.00 t. Revise Bid Package 3 documents to include the additional outlets as described in Extra Work Proposal No. 18 dated 2-23-94. $8,515.00 Amendment No. 7 to CSA -2- Eff. date: 12-20-93 between CCC and KMD U. Remove the special-use area classifi- cation in the surgery department, emergency department, and crisis center as described in Extra Work Proposal No. 16 dated 1-4-94. $31,652.00 V. Prepare an exterior rendering of the new hospital as described in Extra Work Proposal No. 19 dated 3-16-94 $7,950.00 W. Revise Bid Package 2 documents to include the additional underground electrical work as described in Extra Work Proposal No. 20 dated 4-4-94. $7,903.00 Total Amendment No. 7 - Added Services $119,904.00 4. REMAINING PROVISIONS Except for the changes made by this Amendment and prior amendments, all provisions of the Agreement shall remain in full force and effect. S.
