Yancey, District Attorney DATE: March 29 , 1994 Approval for Submission and Execution of Contract With the Office SUBJECT: of Criminal Justice Planning for Funding of The Career Criminal Prosecution Unit for the Period July 1, 1994 to June 30, 1995 SPECIFIC REQUEST(S) OR RECOMMENDATION(S)& BACKGROUND AND JUSTIFICATION I . RECOMMENDED ACTION Authorize the District Attorney to submit an application and execute a grant award contract with the State Office of Criminal Justice Planning for funding of the Career Criminal Prosecution Unit for the period July 1, 1994 through June 30, 1995, in the amount of $191,520 (state funds) . II . FINANCIAL IMPACT This grant contract will be in the amount of $191,520 to fund salaries and benefits for 2 lawyers and . 5 clerk who comprise the staff of the Career Criminal Prosecution Unit, which is located in the Office of the District Attorney, Budget Unit No. 0242, Organization No. 2844. The Office of Criminal Justice Planning, State of California, will fund $191,520 of the cost of this grant. Contra Costa County will not be required to match any portion of the cost of the grant. III . REASONS FOR RECOMMENDATION/BACKGROUND The Career Criminal Prosecution Unit handles felony cases committed by professional criminals who have made a career out of crime. Repeat offenders who commit serious crimes such as robbery, burglary (first and second degree) , arson, grand theft, and receiving stolen property are being prosecuted by this unit. The legislation for this program requires the District Attorney' s Office to use experienced felony trial deputies who are assigned reduced caseloads and who are required to handle the case on a vertical prosecution basis from the time of arraignment continuing. through final sentencing in superior court, including all intervening motions. Continued funding of this grant by the State is contingent upon the County prosecuting these cases as provided within the statutes. Last year, sixty-one (61) of the sixty-four ( 64) career criminals reaching the disposition stage were convicted. All convictions resulted in a sentence to state or local institutions. CONSEQUENCES OF NEGATIVE ACTION Failure to approve this recommendation would result in the inability of the District Attorney to apply for $191,520 in State funds available to prosecute repeat offenders who commit serious crimes such as robbery, burglary, and lewd conduct with children in the County. Since these funds will be built into the District Attorney' s 1994-95 revenue budget, disapproval of the recommendation would create a revenue shortfall of that amount. NOW, THEREFORE, BE IT RESOLVED that the District Attorney of Contra Costa County is authorized, on its behalf, to submit the proposal to OCJP and' is authorized to execute, on behalf of the Board of Supervisors of Contra Costa County, the Grant Award Agreement, including any extensions or amendments thereof. IT IS AGREED that any liability arising out of the performance of the Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grand recipient and the authorizing agency. The State of California and OCJP disclaim any responsibility for any liability.
