HomeMy WebLinkAboutMINUTES - 04191994 - 1.106 ¢ to Contra Costa .., BOARD OF SUPERVISORS County .o¢ �4 Srq Resolution No. 94/2 0 3 Whereas, the Contra Costa County Board of Supervisors, as governing body of the County and of the Contra Costa, Moraga, Orinda, Riverview, and West County fire protection districts, has considered the recommendations of the County Administrator and Acting Director of Personnel regarding the equitable compensation of uniformed fire management employees in County governed fire districts; and Whereas, the Board has been advised that while West County Fire Protection District was administered under contract with Richmond.Fire, there were inadvertent omissions made in the salary and benefit resolutions for unrepresented and management employees which failed to provide those employees with the same compensation as was provided for other fire district employees; The Contra Costa County Board of Supervisors hereby Resolves that Resolutions 89/684, Section III F and 92/107, Section III G, both entitled Fire Service Emergency Recall and Standby Differential, are amended on their respective effective dates to add West County Fire Protection District to the list of covered fire protection districts. Terry has indicated that you advised him that Standby Pay and floating holidays were probably due you at the end of December 1992 after you received our December 28, 1992 letter. Your action prompted Terry on February 2, 1993 to write a memo to the Auditor-Controller asking that they defer making overpayment recovery deductions from your pay until a review of the entire situation was completed. Although you apparently agreed to offset any potential claim you might have for an underpayment by the County against the entire overpayment recovery owed, and Fire Chief Allen Little also agreed to this resolution of your potential claim, the Auditor Controller could not agree to this from an accounting perspective. Therefore, on March 25, 1994, the County Administrator's Office asked us to assist them in investigating your claim. It now appears that several resolutions setting salaries and benefits for managers in the County fire districts overlooked West County F.P.D. and did not provide standby pay for West County F.P.D.'s managers since they were being administered by Richmond Fire Department. To correct that error, the County Administrator and Personnel Department are recommending to the Board of Supervisors that Resolutions 89/684 and 92/107 be amended to correct that error. The resolution is expected to be presented for Board action on April 19, 1994. A copy is enclosed for your information. On the basis of this proposed Board action, we are asking the Auditor-Controller, by copy of this memo, to delay their proposed action to recover the overpayment of "holiday pay" of which you were previously advised, and to calculate the exact amount of underpayment created by the County failing to pay you standby pay, as well as failing to credit you with floating holiday hours. The two year period for recovery of the underpayment of standby pay begins with the discovery of this error and your reporting of it to Terry McGraw and goes back two years (1/1/91-12/31/92) for the standby pay, and 1/1/91-6/30/92 for the floating holiday accruals at 4 hours/month for 56 hour work week employees (6/30/92 being the date on which floating holiday accruals were corrected). From ' that point forward the County should have corrected the situation, but failed to do so, thereby creating further underpayments to you until actually corrected — from 1/1/93 - present for the standby pay. The floating holiday accruals accrued at the 4 hour rate will be converted to the 2 hour rate for purposes of accruals and maximums since you are now on a 40 hour work week schedule. Floating holiday accruals due you will be credited to your floating holiday account. However, any amount over the maximum less 2 hours (one month's accrual in payroll) will be cashed out On this basis, the County appears to have underpaid you a greater amount for standby pay and floating holidays than it overpaid you for holiday pay. The difference is what the County owes you. The Auditor will pay you that amount subject to appropriate tax withholding.
