RECOMMENDATIONS
1. Accept the environmental documentation prepared for this
project as being adequate.
2. Approve rezoning application 13016-RZ as recommended by the
East County Regional Planning Commission as .shown on the
attached Conditions of Approval marked Exhibit A.
3. Adopt the East County Regional Planning Commission's findings
as set forth in Resolution #8-1994 as the determination for
these actions.
4. Introduce the ordinance giving effect to the aforesaid
rezoning, waive reading and set forth date for adoption of
same.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
On February 7, 1994 the East County Regional Planning Commission,
after taking testimony, recommended that the Board of Supervisors
approve the rezoning subject to the Conditions of Ap roval and
findings attached.

This is the time heretofore noticed by the Clerk of the
Board for hearing on the recommendation of the East County
Regional Planning Commission on the request by Ecumenical
Association for Housing (applicant) and Joseph and Lenora Peres
(owners) (3016-RZ) to rezone land from Single Family Residential
District (R-6) to Planned Unit District (P-1) in the Oakley.
Dennis Barry,, Community Development Department, presented
the staff report on the request before the Board described the
location of the proposed site and he recommended that the Board
take testimony and at the conclusion of the hearing, accept the
environmental documentation prepared for the project as being
adequate adopting the Negative Declaration, approve rezoning
application 3016-RZ as recommended by the East County Regional
Planning Commission with conditions of approval, adopt the East
County Regional Planning Commission' s findings for the project as
set forth in Resolution 8-1994 -as the basis for the Board' s
determination in these actions, and introduce the ordinance
giving effect to the aforesaid rezoning, waive reading and set a
date for the adoption of same.

The public hearing was opened and the following persons
presented testimony:
Lamar Turner, Ecumenical Association for Housing, applicant,
spoke in support ,of the proposed rezoning.
Roger J.L. Calvert, 2259 Canterbury Lane, spoke in
opposition to the proposed rezoning.
Tom Buchholz, 5145 Claremont Lane, Oakley, spoke in
opposition to the proposed rezoning.
Richard Bennett, 5174 Claremont Lane, Oakley, spoke in
opposition to the proposed rezoning.
Rod Dupont, !2252 Canterbury Lane, Oakley, spoke in
opposition to the proposed rezoning, and presented photos of the
area.
Chandra J. Calvert, 2259 Canterbury Lane, Oakley, spoke in
opposition to the proposed rezoning.
Ken Buckley, 5160 Kegan Lane, Oakley, spoke in opposition to
the proposed rezoning.
Mr. Turner spoke in rebuttal .
The public hearing was closed.
Supervisor Torlakson moved approval of the rezoning
application and authorization of a letter being sent to the home
builder and the realtors, association in the area relative to the
chronology of Board actions. on this matter, and to authorize
Supervisor Torlakson to meet with the residents and the builder
to address concerns raised today including traffic, access and
safety.
Supervisor Bishop seconded the motion and requested
clarification on the configuration of the streets as to
conformity with County standards.
Mr. Barry responded that the project was according to County
standards and he commented on the parking for the proposed
project .
The Board discussed the matter.
IT IS BY THE.-BOARD ORDERED that recommendations 1, 2, 3, and
4 are APPROVED; and Ordinance No. 94-17, giving effect to the
rezoning, is INTRODUCED, reading waived, and March 15, 1994 is
set for adoption of same.

FINDINGS AND CONDITIONS OF APPROVAL FOR REZONING 3016-RZ
FINDINGS
A. Rezoning is consistent with the General Plan for the subject property.
B. The proposed 5Q senior housing units will improve and increase the -community's
supply of affordable housing.
C. The development will serve the goals and objectives of the redevelopment plan for the
Oakley Redevelopment Area, adopted by the County Board of Supervisors on
December 21 1989.
D. Project will achieve the County's housing element goals and objectives and also will
be consistent. with the requirements of Assembly Bill 315 since 100° of the units
would meet the affordability criteria.
CONDITIONS OF APPROVAL
1 . The rezoning from R-6 to P-1 of the subject property is approved to support the
construction of 50 senior housing units. If a senior citizen housing is not constructed,
the rezoning will be null and void and the property will be limited to a Single Family
Residential-High Density as allowed by the pre-existing land use designation.
2. Within 18 months after the effective date of the establishment of the P-1 district, the
applicant shall submit a final development plan for review and approval of the Zoning
Administrator.
3. The following requirements pertaining to drainage, road, and utility improvements will
require the review and approval of the Public Works Department:
A. FRONTAGE IMPROVEMENTS
The Ordinance Code requires the installation frontage improvements along
Oakley Road and Kelsey Lane, and contribution to a Road Improvement Fee
Trust for the construction of a half-width median island along the oakley Road
frontage. These conditions were previously placed upon Subdivision 7330, of
which-the subject property was a part. Because these conditions have already
been fulfilled with the previous subdivision, no frontage improvements shall be
conditioned as a part of this development. The applicant shall be required to
repair any damaged frontage improvements along the property prior to
occupancy.
B. ROAD DEDICATIONS
1) Convey to the County, by Offer of Dedication, additional right of way
on Oakley Road along the Parcel A frontage as required for the planned
future half-width of 30 feet.

2) Relinquish abutter's rights of access along the entire Oakley Road
frontage, including the curb return, and along Kelsey Lane with the
exception of the proposed private access road.
C. STREET LIPHTS
Install street lights on Oakley Road and annex the property to County Service
Area L-100 for maintenance of the street lights. The final number and location
of the lights shall be determined by the County Traffic Engineer.
D. DRAINAGE IMPROVEMENTS
1) Division 914 of the Ordinance Code requires conveying of all storm
waters entering or originating within the subject property, without
diversion and within an adequate storm drainage facility, to a natural
watercourse having definable bed and banks or to an existing adequate
public storm drainage facility which conveys the storm waters to a
natural watercourse.
2) . Design and construct storm drainage facilities required by the Ordinance
in compliance with the design standards of the Public Works Depart-
ment.
E. GENERAL REQUIREMENTS
11 Submit improvement plans prepared by a registered civil engineer,
payment of review and inspection fees, and security for all improve-
ments required by the Ordinance Code or the conditions of approval for
this subdivision. These plans shall include any necessary traffic signage
and striping plans for review by the County Public Works Department,
Road Engineering Division.
2) Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across the sidewalks and drive-
ways.
3) Construct the on-site driveway system to current County private road
standards with a minimum width of 28 feet (curb to curb).

FOR THE PURPOSE OF INFORMING THE APPLICANT OF ADDITIONAL ORDINANCE
REQUIREMENTS THAT MUST BE MET IN ORDER TO PROCEED WITH DEVELOPMENT.

A. Comply with the requirements of the Ironhouse Sanitary District.
B. Comply with the requirements of the Oakley Fire Protection District.
C. The applicant will be required to comply with the requirements of the
Bridge/Thoroughfare Fee Ordinance for the Oakley/North Brentwood Area of Benefit
as adopted by the Board of Supervisors.
D. The applicant- will be required to comply with the drainage fee requirements for
Drainage Area 29H as adopted by the Board of Supervisors.
E. The applicant shall be required to comply with all rules, regulations, and procedures of
the National Pollutant Discharge Elimination System (NPDES) for municipal, construc-
tion and industrial activities as promulgated by the California State Water Resources
Control Board, or any of its Regional Water Quality Control Boards (San Francisco Bay-
Region II or Central Valley - Region V).

RESOLUTION OF THE EAST COUNTY REGIONAL PLANNING COMMISSION OF THE
COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA, INCORPORATING FINDINGS
AND RECOMMENDATIONS ON THE REQUESTED ' CHANGE BY -ECUMENICAL
ASSOCIATION FOR HOUSING (APPLICANT) AND JOSEPH & LENORA PERES
(OWNERS)' (3016-RZ) , IN THE ORDINANCE CODE SECTION PERTAINING TO
THE PRECISE ZONING FOR THE OAKLEY AREA OF SAID COUNTY.
WHEREAS, :a request by Ecumenical Association For Housing
(Applicant) and Joseph & Lenora Peres (Owners) (3016-RZ) to rezone
land in the Oakley area from Single Family Residential District (R-
6) to. Planned Unit District (P-1) was received on November 23,
1993; and
WHEREAS, in connection with applicant's requests, an Initial
Study of Environmental Significance was prepared by the Community
Development Department which determined that the requested
entitlements would not have any significant adverse environmental
impacts; and
WHEREAS, for purposes of compliance with provisions of the
California Environmental Quality Act and State and County CEQA
guidelines, a Negative Declaration of Environmental Significance
was prepared, posted and circulated; and
WHEREAS, after notice was lawfully given, a public hearing was.
scheduled before the East County Regional Planning Commission on
Monday, February 7, 1994; whereat all persons interested might
appear and be heard; and
WHEREAS, on Monday, February 7, 1994, the East County Regional
Planning Commission having fully reviewed, considered and evaluated
all the testimony and evidence submitted in this matter; and
NOW, ..THEREFORE, BE IT RESOLVED that East County Regional
Planning Commission recommends to the Board of Supervisors of the
County of Contra Costa, State of California, that the rezoning
request of Ecumenical Association For Housing (Applicant) and
Joseph & Lenora Peres (Owners) (3016-RZ) be approved for change
from Single Family Residential District (R-6) to Planned Unit
District (P-1) , and that this zoning change be made as indicated on
the findings map entitled: Page G-24 of the County's 1978 Zoning
Map.

BE IT FURTHER RESOLVED that the reasons for this
recommendation are as follows: s

BE- IT FURTHER RESOLVED that the Secretary of the East County
Regional Planning Commission shall respectively sign and attest the
certified copy of this resolution and deliver the same to the Board
of Supervisors all in accordance with the Planning Laws of the
State of California.
The instructions by the East County Regional Planning
Commission to prepare this resolution were given by motion of the
East County Regional Planning Commission on Monday, February 7,
1994, .by the following vote:

B. ROAD DEDICATIONS
1) Convey to the County, by Offer of Dedication, additional right of way
on Oakley Road along the Parcel A frontage as required for the planned
future half-width of 30 feet.

C•. STREET LIGHTS
Install street lights on Oakley Road and annex the property to County Service
Area L-100 for maintenance of the street lights. The final number and location
of the lights shall be determined by the County Traffic Engineer.
D. DRAINAGE IMPROVEMENTS
1) Division 914 of the Ordinance Code requires conveying of all storm
waters entering or originating within the subject property, without
diversion and within an adequate storm drainage facility, to a natural
: watercourse having definable bed and banks or to an existing adequate
public storm drainage facility which conveys the storm waters to a
natural watercourse.
2) Design and construct storm drainage facilities required by the Ordinance
in compliance with the design standards of the Public Works Depart-
ment.
E. GENERAL REQUIREMENTS
1) Submit improvement plans prepared by a registered civil engineer,
payment of review and inspection fees, and security for all improve-
ments required by the Ordinance Code or the conditions of approval for
this subdivision. These plans shall include any necessary traffic signage
and striping plans for review by the County Public Works Department,
Road Engineering Division.
2) Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across the sidewalks and drive-
ways.
3) Construct the on-site driveway system to current County private road
standards with a minimum width of 28 feet (curb to curb).

I. INTRODUCTION
ECUMENICAL ASSOCIATION FOR HOUSING (Applicant) -JOSEPH & LENORA PERES
(Owners), County File #3016-RZ: The applicant requests approval of a rezoning
proposal to change the zoning designation on a 1.92:t acre property from Single
Family Residential (R-6) to Planned Unit District (P-1). Subject property is located at
#2300 Oakley Road. The site is Lot 101 of Subdivision 7330 and is located east of
Kelsey Lane'and on the north side of Oakley Road, in the Oakley area. (R-6) (ZA: G-
24) (CT 3020.00) (Parcel #037-390-101).
ll. RECOMMENDATION
Staff recommends that the Planning Commission adopt a resolution recommending that
the Board of Supervisors approve County File #3016-RZ, subject to the attached
Conditions of Approval.
III. GENERAL INFORMATION
A. General Plan Designation: Multiple Family Residential-Very High Density(30.0-
44.9.'units/net acre).
B. Zoning: Current - Single Family Residential (R-6).
Proposed - Planned Unit District (P-1).
C. CEQA Status: A Negative Declaration of Environmental Significance for 3016-
RZ was posted on December 23, 1993.
D. Previous Applications:
1. 5-93-EC: The General Plan on the subject property was changed from
Single Family Residential-High Density (5.0 - 7.2 units/net acre) to
Multiple Family Residential-Very High Density (30.0 - 44.9 units/net
acre) by the Board of Supervisors in June, 1993. The GP was changed
specifically to support the development of 50 senior, clustered housing
units. If senior housing is not built, the GP wil revert to Single Family
Residential-High Density.
2. MS 17-93: A minor subdivision to subdivide the entire parcel into 3 lots
with a designated remainder was approved by the Zoning Administrator
on August 23, 1993. If senior housing is not built, MS 17-93 would be
valid.
IV. AGENCY COMMENTS
.'A. GMAC: GMAC recommended approval to rezone the property to-P-1 for senior
residential rentals (see attached).
B. Redevelopment Anency: Project is consistent with General Plan designation.
It will provide much needed housing units for low and moderate income senior
residents.
C. Building Inspection Department: No comments.
D. Contra Costa Water District: No comments.
E. Oakley Fire Protection District: See attached.
F. California Archaeological Inventory: There is a low possibility of archaeological
sites. Further study for archaeological resources is not recommended.
G. Ironhouse Sanitary District: See attached.
H. Public Works Deoartment - Special Districts: No comments.
V. SITE DESCRIPTION
The subject property is a rectangular shaped parcel consisting of 1.92 acres. The site
contains a detached single family structure with related accessory structures. There
are several trees on the property.
V1. AREA DESCRIPTION
A single family residential subdivision (H'eather Park) is located to the north and west
of the subject property. There is a vacant parcel to the east. Single family ranchette
homes are scattered along Oakley Road. New single family homes are under
construction near the intersection with Empire Avenue, on the east. Five 2-story single
family homes are located along the northern border of the subject property.
V11. PROJECT DESCRIPTION

The applicant is requesting a rezoning on a 1.92± acre parcel from R-6 to P-1. The
property is proposed to be developed for 50 senior housing units and a community
building. Only a schematic site plan has been submitted with this application. All
other submittal requirements were waived by the Director of Community Development
as per Section 84-66.1006 of the County Zoning Ordinance. See attached letter.

The applicant intends to apply to the State for a Low-Income Tax Credit. This
application can be submitted only when the zoning is consistent with the General Plan.
Should the State deny this application, the proposal to construct 50 units of low
income senior housing most likely will not proceed. A final development plan
application will be submitted by the applicant after the rezoning is appro_ved by the
Board of Supervisors and a tax credit is granted by the State. "
VIII. BACKGROUND INFORMATION
In October, 1991 Supervisor Torlakson requested that the County begin the process
which would result in the provision of senior housing in the Oakley area. In response
to this request, OMAC created a subcommittee known as Citizens for Affordable
Senior Housing (CASH), and in August, 1992 issued a formal report, which examined
in more detail the need for senior housing in the Oakley area. The report found a very
high demand for senior housing in the Oakley area.
In early 1993, OMAC began working with the County Redevelopment Agency staff to
begin the process of site acquisition and development for a senior housing project.
Thirteen (13) sites which were within 1/2 mile walking distance to major shopping
centers and pharmacies were initially considered before the subject property at #2300
Oakley Road .was selected. The County Redevelopment Agency and the non-profit
developer, Ecumenical Association for Housing are jointly working on this project.
IX. ' 'ROAD AND DRAINAGE CONSIDERATIONS
The attached:conditions of approval based on the July, 1993 site plan include road and
drainage requirements. The applicant should be fully aware of the County Ordinance
Code requirements as they pertain to this development.
Rezoning 3016-RZ is a rezoning from R-6 to P-1 . The Public Works Department is
commenting on this rezoning to insure that the corresponding development plan meet
the requirements of the Ordinance Code and the Public Works Department. The
conditions of approval may be modified when the actual development plan is
considered for approval.

Section 84-66. 1006 of the Zoning Ordinance allows for certain
information to, be waived by the Planning Director when submitting
a P-1 rezoning application and seeking concurrent preliminary
development plan approval.
Ecumenical Association for Housing (EAH) , the project sponsor, will
be submitting a rezoning Application from R-6 to P-1 for a proposed
50 unit senior- housing complex. The Redevelopment Agency requests
that EAH be exempt from submitting the following information with
the rezoning application:
1) a preliminary development plan.-
2) schematic drawings
Releasing the sponsor from this requirement will prevent EAH from
spending monies for preliminary site plans and related fees prior
to receiving approval of their state Low-Income Tax Credit
Application. Should the state deny this application, the proposal
to construct ..the 50 units of senior housing for low income
residents most likely will not proceed. Requiring the preliminary
development plan and schematic drawings may be premature and
costly.
Should EAH receive approval of the Tax Credit Application, a final
development plan will then 'be submitted.

We have reviewed the Application for a Rezoning, dated November 23, 1993, for the subject project.
The application consists:of a request for a rezoning of existing single-family residential use to
multiple-family residential (very high density) to accommodate the proposed construction of
approximately fifty (50). units of senior housing. This project is subject to fire and life safety
requirements of the Uniform Fire Code, as adopted by Contra Costa County Ordinance 89-71, and any
applicable provisions of the California State Fire Marshal's regulations.
We have no comments relative to the rezoning, however, we request the opportunity to again comment
when the senior housingproject reaches the Use Permit stage of the development process. At that time,
the following Uniform Fire Code and State Fire Marshal requirements must be included as Conditions
of Approval:
SPECIFIC CONDITIONS:
1. The developer shall provide an adequate and reliable water supply for fire protection.

2. The developer shall provide access roadways with all-weather driving surfaces of not less
than 20 feet of unobstructed width, and not less than 13'-6" of vertical clearance, to
within 150 feet of all portions of the exterior.walls of every building. Access roads shall
not exceed 16% grade, and shall have a minimum outside turning radius of 45 feet, and
must be engineered to support the impose loads of fire apparatus (30 tons maximum).

3. Dead-end fire department access roads in excess of 150 feet long shall be provided.with
approved provisions for the turning around of fire department apparatus.

in such a manner as to be plainly visible and legible from the street or road fronting the

5. The developer shall submit two (2) sets of Improvement Plans to the Fire District for

6. The developer shall be required to contribute Fire Facility Fees to mitigate operational
costs associated with increased service demands throughout the Fire District. The
developer shall pay all required Fire Facility Fees prior to the issuance of any building
permit.
7. The developer shall comply with all applicable requirements of the Uniform Fire Code
and the adopted policies of the Oakley Fire Protection District. [1.103 UPC]
These conditions are intended to ensure that the project will be in general compliance with applicable
fire codes and regulations enforced by the Oakley Fire Protection District. Review of subsequent plan
submittals, required above, may result in additional requirements. Projects beginning construction more
