Powers NOES: None ABSENT: Supervisor McPeak RESOLUTION NO. 94/169 SUBJECT: Rejecting Bids for Second Floor Repair at 30 Muir Road, Martinez for Social Service Department Authorization No. WPE182 The Director of General Services having received bids on January 20, 1994 for Second Floor Repair at 30 Muir Road, Martinez for Social Service Department; and The Affirmative Action Officer having determined that none of the three lowest bidders have met the goals or provided satisfactory documentation of ,good faith effort to comply with the requirements of the County's Minority and Women Business Enterprise Contract Compliance Program, the fourth bidder having omitted the required MBE/WBE bid information, and the fifth bid being $40, 000 higher (Base Bid only) than the lowest bid; NOW, THEREFORE, the Board of Supervisors, in it' s discretion, REJECTS all bids and DIRECTS the Director of General Services to revise the bid documents as necessary for rebidding the project, and to present the revised plans and specifications to the Board for approval . Gilbert, Dir*or "GeneraklServices SUBJECT: CONTRACT AWARD RECOMMENDATION; Agenda Date March 1, 1994 Authorization No. WPE182 Bids for Second Floor Repairs at 30 Muir Road; Martinez, for Social Service Department, were received and opened at the County Architectural Division Offices on Thursday, January 20, 1994. The Affirmative Action Officer has determined that none of the three lowest bidders met the MBE/WBE goals (i.e. 14% and 6%) or provided satisfactory documentation of good faith effort. The fourth bidder omitted the required MBE/WBE bid information. The fifth bidder is $40,000 higher (Base Bid only) than the low bidder and its good faith effort has not been evaluated. The lowest bidder, William Dahn Construction, and several other bidders listed Horizon Sheet Metal as an MBE or WBE subcontractor. Horizon is listed as a certified MBE or WBE in the 1992-93 City of Oakland directory. If the bidders had requested a copy of Horizon's certification it would have shown that its certification had expired in 1992. Horizon did not apply for renewal until December 13, 1993. The City of Oakland, as of February 15, 1994 reports that it intends to deny recertification. Since the bids, in general, do not meet requirements of the MBE/WBE program, the Board of Supervisors may reject all bids and direct us to revise the bid documents as necessary for rebidding the project and to present the revised plans and specifications to the Board for approval. None of the three lowest bidders met the WBE goal or documented a good faith effort to meet the goals. My recommendation is to reject all bids.
