SUBJECT: CYPRESS ROAD @ SELLERS AVENUE INTERSECTION - OAKLEY AREA

SPECIFIC REOUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated February 16, 1994,
from Evo S. Baldocchi, et. al.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $1,150.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check 'in said amount payable to Evo S. Baldocchi, 6390 Sellers
Avenue, Oakley, CA., 94561, to be forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $1,150.00 from the Oakley Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Cypress Road @ Sellers Avenue Intersection
Improvement project in accordance with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications. ''JJ

Real property in the unincorporated area of Oakley, Contra Costa County,California, being a portion
of the southwest quarter of Section 29, Township 2 North, Range 3 East, Mount Diablo Meridian,
described as follows:
A portion of that parcel of land described in the deed to Rosa M. Baldocchi Trust recorded
November 6, 1992 in Volume 18008 of Official Records at page 857, described as follows:
Beginning at the intersection of the south right of way line of East Cypress Road and the east right
of way line of Sellers Avenue; said Point of Beginning bears south 89015'39" east 30.00 feet and
south 1021'W west 30.00 feet from the Contra Costa County monument marking the east quarter
comer of Section 30 (UN, R3E); thence from the Point of Beginning along said south line of East
Cypress Road, south 89015'39"east 50.00 feet; thence leaving said south line, south 59056'30"west
58.59 feet,to the east right of way line of Sellers Avenue; thence along said east line, north 1021'54"
