BACKGROUND: The Keller Canyon Landfill Citizens Advisory Committee has informally established terms for its members . In order to reconcile the records of the Clerk of the Board with those of the Advisory Committee, it is recommended that the Board fix terms consistent with those established informally by the Advisory Committee. In doing so, the terms of these three members expired December 31, 1993 . Each wishes to be reappointed and our Committee is pleased to recommend their reappointment. Zahn, Assistant Director SUBJECT: MEMBERSHIP REAPPOINTMENTS FOR THE KELLER CANYON LANDFILL LOCAL ADVISORY COMMITTEE There are three reappointments for the Keller Canyon Landfill Local Advisory Committee(LAC) to be considered. The two-year membership term (set by the LAC's By-Laws) for the below members have expired. Carmen Gaddis representing the County Planning Commission, Al McNabney representing the Mount Diablo Audubon Society, and Joanne Wright representing the Sierra Club have expressed interest in reappointment. The County Planning Commission, the Mount Diablo Audubon Society, and the Sierra Club have endorsed these reappointments and the letters of endorsement are attached. The LAC has not expressed any objections to these reappointments. Staff concurs with the requested reappointments. It is my understanding that Ms. Gaddis is willing to continue to serve in this capacity. Please take whatever steps are necessary in order to process this appointment so that Ms. Gaddis can timely represent the Planning Commission. PLEASE NOTE: THE NEXT MEETING OF THE CONTRA COSTA COUNTY PLANNING COMMISSION WILL BE ON TUESDAY, FEBRUARY 15, 1994. The Planning Commission at hearings on zoning matters, variances or land use permit applications, must base their decision on competent evidence. Letters will be received and filed but cannot, in general, be considered competent- evidence unless personally presented at a hearing by a witness, subject to examination. BYLAWS OF THE CONTRA COSTA COUNTY KELLER CANYON LANDFILL LOCAL ADVISORY COMMITTEE With consensus of the Keller Canyon Landfill Local Advisory Committee, these By- Laws are submitted to the Board of Supervisors for their approval. I. Objectives of the Committee A. The prime responsibility of the Committee is to advise and recommend on the development of the Keller Canyon Landfill and its operations to the Board of Supervisors. II. Functions of the Committee The Committee shall consider matters in the areas of: * safety and emergency .procedures; * any landfill-related problems (including traffic); * screening of visual impacts; * litter, odor and noise control; * providing a forum for landfill-related issues; * coordination between the public and the County in resolving complaints; * discussion on reports on landfill and construction, operation and maintenance. Other than the advisory and coordinating functions designated above, all decision- making authority is retained by the County. III. Structure and Operations of the Committee A. The Committee shall consist of ten (10) voting members appointed by the Board of Supervisors. The Committee will be governed by regulations in the Brown Act. An alternate, , authorized by the representative agency, may attend and vote at meetings in lieu of appointed member as necessary. The landfill operator, Browning-Ferris Industries, shall be represented on the Committee as a non-voting member. The Committee members shall be nominated from, and represent, the constituencies named below after due consultation with said constituencies: f ' Bylaws - Keller Canyon Landfill LAC Page -2- 1 The City of Pittsburg 2. Committee members shall be appointed for staggered terms of two calendar years. C. Committee members may be reappointed for consecutive terms. D. Committee members missing three consecutive meetings without notifying staff or Committee Chair, after due notice by staff, shall be considered as vacating their position. E. Each Committee member may be considered for removal from the Committee upon recommendation of his/her respective nominating constituency (ies). F. Committee members whose terms have expired may serve until replaced. G. The Committee shall establish regularly scheduled dates and times for the Committee meetings. The Committee shall elect a Chairperson and Vice-Chairperson for terms of one calendar year. 1 . The Clerk of the Board of Supervisors shall be notified of the selection of the Chairperson and Vice-Chairperson. 2. The Chairperson and Vice-Chairperson may serve no more than two consecutive terms in each position. 3. The Vice-Chairperson shall serve in the absence of the Chairperson. I. The Chairperson shall be responsible for: 1 . Conducting all meetings of the Committee. 2. Selecting Committee members for standing and ad hoc committees. 3. Representing the Committee (or designating a person to represent the Committee) before the Board of Supervisors and its committees when appropriate. 4. Notifying the Vice-Chairperson of his/her absence from a scheduled meeting. 5. The review and approval. of Committee meeting agendas. J. Business shall be conducted by the Committee only when a quorum is present. The quorum shall be a majorityof seated, voting members. K. While normal Committee business may be conducted with only a quorum present, final recommendations of the Committee to the Board of Supervisors shall require a majority of those present, except as indicated in Section IV.A. for any proposed amendments to the Bylaws. L. The Committee's findings and recommendations shall normally be in the form of letters, resolutions or reports to the Board of Supervisors. Bylaws - Keller Canyon Landfill LAC Page -4- M. The Committee shall submit an annual (calendar year) report to the Board of Supervisors of the. Committee's activities, accomplishments, attendance, and a proposed program for the forthcoming year. N. The Committee will receive primary staff support from the County Community Development Department. The Community Development Department staff is responsible for: 1 . Assuring that the Chair and Committee are appraised of matters concerning Keller Canyon Landfill and all Committee correspondence within three (3) business days. 2. Drafting and submitting the Committee agenda for the Chairperson's approval. 3. Preparing and distributing the approved agenda and agenda materials at least one week prior to scheduled meetings. 4. Arranging for Committee meetings. 5. Preparing meeting minutes, reports, recommendations, and resolutions for information and/or approval of the Committee as requested or needed. 6. Representing the Committee in the absence of Chair/Vice Chair or at request of Committee. 7. Being the agent of the Committee to which requests for Committee action, correspondence, information, inquiries, etc., are directed. 8. Coordinating joint staffs when they are used. 9. Providing or coordinating staff services to committees. 10. Providing relevant information to the public, the County, and the Committee. 11 . Forwarding and taking the necessary actions .on the adopted recommendations, findings, and actions of the Committee within designated timetable set by Committee.
