SUBJECT: EMPIRE AVENUE BRIDGE REPLACEMENT - OAKLEY AREA

SPECIFIC REQUEST(S) OR WE-COMMENDATION(S ) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated February 24, 1994,
from Contra Costa Water District and Diablo Water District.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $950.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in the amount of$593.75 to Contra Costa Water District, P.O.
Box H2O, Concord, Ca., 94523, and in the amount of $356.25 to Diablo Water District,
P.O. Box 127, Oakley, Ca., 94561, to be forwarded to the Real Property Division for
delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact-
Payment of $950.00 from Oakley Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Empire Avenue Bridge Replacement project in
accordance with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in the northeast quarter of the northeast quarter of Section 34, Township 2 North,
Range 2 East, Mount Diablo Meridian, Contra Costa County, California, being portions of that parcel
of land described as MORI PARCEL"B" in the Final Order of Condemnation by Contra Costa Water
District recorded March 29, 1991 in Volume 16489 of Official Records at page 147, described as
follows:
PARCEL 1: (Fee Title)
Commencing in the intersection of Empire Avenue and Laurel Road at the iron pipe marking the
northeast comer of Section 34 (UN, R2E);thence along the north line of Section 34, north 88059'22"
west 579.48 feet,to the northerly prolongation of the east line.of said MORI PARCEL"B" (16489 O.R.
147); thence along said prolongation, south-0043'55" west 22.50 feet, to the Point of Beginning at
the northeast corner of said MORI PARCEL"B'; thence from the Point of Beginning along the east
line of said MORI PARCEL "B", south 0°4355" west 12.00 feet, to a point hereinafter referred to as
Point ON; thence leaving said east line, north 88030'00"west 56.00 feet; thence north 83045'00"west
