Cooperation(TRANSPAC), 100 Gregory Lane, Pleasant Hill 94523, requesting the Board to revise
the western boundary of the proposed fee area to the line established by the Contra Costa
Transportation Authority, and also requesting notification of any proceedings/hearings on the
proposed fee.

Dear Chair Powers andel Members of the Board of Supervisors:
TRANSPAC, the Regional Transportation Planning Committee for Central Contra Costa,
needs to raise a serious!!issue regarding the establishment of the Eastern Contra Costa Sub-
Regional Transportation Mitigation Fee. TRANSPAC recognizes that the County, in
cooperation with the cities of Antioch, Brentwood, and Pittsburg, has worked diligently to
develop a regional transportation mitigation fee program for Eastern Contra Costa.
TRANSPAC has followed the formation of the East County program with considerable
interest.
There are two issues regarding the Eastern Contra Costa Sub-Regional Transportation
Mitigation Fee programthat TRANSPAC would like to bring to your attention. The first
concern is that, while not required by the procedures established by the Contra Costa
Transportation Authority, TRANSPAC and, at least the member cities of Clayton and
Concord, would have appreciated receiving a Notice of Public Hearing for this program.
We believe that notice was warranted as the mitigation fee program affects the spheres of
influence of these TRANSPAC cities. Our particular interest in distribution of the Notice
relates to our second concern regarding the proposed western boundary for the fee area.
According to the Notice of Public Hearing, the western boundary of the fee area generally
follows a line roughly defined by the Willow Pass Grade, the limits of the City of Clayton
and Morgan Territory Road. In our view, the western boundary of the fee area is actually
located in Central, not Eastern, Contra Costa. As a result, the fee as currently proposed,
will be imposed in the spheres of influence of the cities of Concord and Clayton, located in

While we understand that the land inside the fee boundary is unincorporated and therefore,
under the jurisdiction of the County, we believe that it is inappropriate for the fee to be
imposed outside of Eastern Contra Costa. TRANSPAC cities have not had a voice in the
determination of the improvements to be funded with the fee. Further, at least one of the
proposed improvements violates the adopted tenets of the Central County Action Plan. The
County, through the TRANSPLAN planning process, has the authority to establish fees;
however, those fees should not extend into the County's TRANSPAC area.

TRANSPAC requests that the Board of Supervisors 1) revise the western boundary of the fee
area to the line established by the Contra Costa Transportation Authority as the boundary
between TRANSPAC and TRANSPLAN and; 2) direct that TRANSPAC receive official
notice of any proceedings and/or hearings on the proposed fee.
TRANSPAC appreciates your consideration of our requests and urges that the Board not
impose the Eastern Contra Costa Sub-Regional Transportation Mitigation Fee in Central
Contra Costa.
