C.0;_. 651 Pine Street, Room 106 Martinez, CA 94553-1290 RE: Scheduled Suisun Bay and New York Slough Maintenance Dredging and Execution of Project Cooperation Agreement with the San Francisco District, U.S. Army Corps of Engineers by County Board of Supervisors Dear Chairman Torlakson: I understand that the Board of Supervisors has under final consideration before execution the companion Project Cooperation Agreement with the San Francisco District, U.S. Army Corps of Engineers to the Modification No. 1 to the Agreement Between the United States of America and the Stockton Port District for Local Cooperation on the San Francisco Bay to Stockton, California Project, Avon to Stockton (John F. Baldwin and Stockton Ship Channels) executed by the Port on January 10, 1994 providing for the orderly assumption of local responsibility concerning project maintenance for those project elements within the jurisdictional boundaries of Contra Costa County and the Corps' San Francisco District. WASHINGTON ST., STOCKTON, SAN JOAQUIN COUNTY, CALIFORNIA The Honorable Tom Torlakson February 17, 1994 Page two and the Board dated October 18, 1993, and by attached copy of correspondence between the Corps and the Port dated February 3, 1994, that the Corps has scheduled maintenance dredging of the Suisun Bay and New York Slough channels for Fiscal year 1994 for summer 1994 that will require the designation, site preparation, and required approval of a suitable dredged material disposal site with the capacity for reception of approximately 100,000 cubic yards of material from the New York Slough channel and possibly an additional 150,000 cubic yards from the Suisun Bay channel if for any reason the Federal site is determined to be unsuitable for aquatic disposal. The attached correspondence indicates that the District operations branch is working with the State Department of Water Resources for the purpose of utilizing dredged material for levee rehabilitation on Jersey Island. However, you will note that the proposed schedule dictates that concurrent exploration of alternative sites would appear to be prudent. For this purpose the Port is prepared to offer the County the use of the Port-owned Donlon Island site on the condition that the County has executed either the LCA or the Interim Supplemental Agreement transmitted to the County on December 10, 1993, providing for the interim assumption of local sponsorship responsibilities by the County pending the execution of the LCA with the Corps' San Francisco District, including the interim responsibility for site preparation and approval for site use by the Corps as necessary in connection with the scheduled maintenance dredging. Absent either intervening action by the Board in the interim, the Board of Commissioners of the Stockton Port District would need to convene at the latest at-its regularly scheduled meeting on March 21, 1994, to consider taking final action on pending Resolution No. 6636 Ordering the Formation of the John F. Baldwin (Avon to New York Slough) and Stockton Ship Channels Maintenance Assessment District 92-1 and for other purposes. This action will be necessary in order to afford the Port sufficient time to discharge its local responsibilities under the existing LCA within the necessary time frame to accommodate the proposed maintenance dredging cycle as set forth in the attached correspondence. Regardless, we will continue to work cooperatively with the Board in resolving and concluding this matter to the benefit of all parties concerned and The Honorable Tom Torlakson February 17, 1994 Page three we acknowledge your considerable individual efforts and those of your staff, as well as the manifest cooperation and comity exhibited by the other members of the Board to date. We will endeavor to keep you informed as to any further actions taken by the Board of Commissioners and request that you do likewise. I remain confident that the final outcome of our mutual efforts will be successful reflecting well on both bodies and commensurate with the considerable mutual time and efforts expended in this regard toward a common goal. Box 2089 Stockton, California 95201-2089 Dear Mr. Krygsman: This letter advises the Port of Stockton of the San Francisco District's Fiscal Year 1994 maintenance dredging schedule for Suisun Bay and New York Slough Channels . At this time, we anticipate dredging an estimated 150,000 cubic yards from the Suisun Bay Channel and 100,000 cubic yards from the New York Slough Channel . We anticipate the material from both channels to be primarily sandy soils . Please note that the quantities may differ from those estimated at this time, due to shoaling, scouring, and sedimentation caused by winter storms . We have scheduled the disposal of the Suisun Bay Channel material in the historical Suisun Bay Channel site. We have scheduled the New York Slough disposal for a site provided by the local sponsor, the Port of Stockton, per the 1982 Local Cooperation Agreement (LCA) , paragraph l.a. General Requirements, subparagraphs ( 1) and (2) . Based on our historical records, we recommend that you provide capacity to accommodate approximately 100,000 cubic yards of in-place material. To provide the necessary assurances, the Corps requests that you submit the following for -the Corps of Engineers review and comments : a. The design of the disposal area to include, but not be limited to the weir(s) and the leeves, the design criteria, water quality, materials testing, and analysis used to formulate the design. b. The holding capacity and concentration time of the disposal area computed by a registered, licensed professional engineer. c. A drawing which depicts the prepared disposal area. The drawing(s) should include a plan view of the disposal area, cross sections at 50-foot intervals showing floor elevations within the area, before and after construction, along with inside and outside dike slopes, weir size(s) , and location(s) . d. A schedule showing when the disposal area preparation will be completed. e. Inspection of the disposal area dikes by your office to be accompanied by a representative from our office shouldbe scheduled to assure their integrity so that corrective measures, if any, can be implemented prior to contract award. f. All Corps of Engineers comments shall be considered by the Port of Stockton prior to use of the disposal structure for disposal of materials in this project. We are working with -the California State Department of Water Resources for utilizing the material from subject projects for levee rehabilitation on Jersey Island. We will keep you informed of -developments. However, it is adviseable and prudent to plan for a site provided by the Port of Stockton per the LCA in the event an alternative solution is not found and -implemented in time.
