1.91iLETTER dated February 11, 1994, from Mary Erbez, Mayor, Vice
Chair, Keller Canyon Landfill Local Advisory Committee, P.O. Box
1518, Pittsburg 94565, requesting the Board to adjust fees
collected at the Keller Canyon Landfill in line with the
Consumer Price Index as stipulated in the Landfill agreements,
and to collect any post due interest that may have accrued on
the fees for lack of timely collection and payment by the
Landfill operators.

possible code violations on property located on Laverock Lane,
Alamo.

1.93 LETTER dated February 15, 1994, from Bobbie Landers, Mayor, City
of Orinda, 26 Orinda Way, Orinda 94563, advising that the City
cannot support the LAFCO application as submitted as it pertains
to the consolidation of the Orinda Fire Protection District
because it provides no assurance that existing service levels
will be maintained.

Dear Supervisor Powers:
At our last meeting the Keller Canyon Landfill Local Advisory Committee ("KCLAC')
passed, by majority, a motion to send a letter to the Board of Supervisors concerning the
assessment of the Keller Canyon mitigation funds. The motion passed by the committee
asks the Board of Supervisors to retroactively collect and continue to collect from the Keller
Canyon Landfill Company the correct fees paid into the Transportation and
Agricultural/Open Space trust funds respectively covered by Special Condition of approval
35 of LUP 2020-89 and the Community Host Mitigation Fee covered by the Franchise
Agreement between Contra Costa County and the Keller Canyon Landfill Company.
These contractual documents stipulate that the fees be automatically adjusted annually on
the anniversary of the landfill's opening by the latest CPI. Our latest information is that the
the fees have not been so adjusted. As these fees were negotiated and agreed to by all
parties upon signing of the Franchise Agreement and the issuance of Land use permit 2020-
89 and are conditions of these contractual documents this committee and the Citizens of
Contra Costa County expect the proper fees to be collected and distributed on a timely
basis.
Recently members of the Board have publicly discussed the positive impact of these fees on
Contra Costa County and it's communities. The increases in the fees, by adjusting for the
CPI, would only increase the value of these assessmsents to Contra Costa County and it's
citizenry.

The KCLAC asks the Board to request that the County Administrator increase the fees as
stipulated in the Landfill agreements and collects any past due interest that may have
accrued on the fees for lack of timely collection and payment by the Landfill Operators.
