Project No. 0672-6U2000-94, CP # 94-6.
Specific Request(s) or Recommendation(s) & Background & Justification
I. RECOMMENDED ACTION:
APPROVE Project, and
DETERMINE that the project is a California Environmental Quality Act Class 1c Categorical
Exemption, and DIRECT the Public Works Director to prepare contract plans and specifications
for construction.
DIRECT the Director of Community Development to file a Notice of Exemption with the County
Clerk.
DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the
County Clerk for filing of the Notice of Exemption.
II. FINANCIAL IMPACT:
The estimated project cost is $1,450,000, funded by road funds (100%)
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project includes placing asphalt concrete overlays, pavement reinforcing fabric, asphalt
rejuvenating materials, slurry seal, or chip seal treatments to existing County roads.

It is needed as an economical, routine maintenance for existing road surfaces, and is intended
to prolong pavement service life.
The project has been determined to be in compliance with the General Plan and is exempt from
CEQA because it consists of minor alterations of existing public facilities involving no expansion
of use per Section 15301(c) of the CEQA Guidelines.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction.

Project Description, Common Name (if any) and Location: 1994 ROAD SURFACE TREATMENTS #CP 94-6:
The 1994 road surface treatment projects consist of placing asphalt concrete overlays, pavement
reinforcement fabric, asphalt rejuvenating materials, slurry seal, or chip seal treatments to existing road
surfaces. The projects may also include one or more of the following activities: (1) Pavement striping/
painting messages/pavement marker replacements; (2) Minor reconstruction (i.e., excavating and replacing
roadway); (3) Street and driveway conforms; (4) Placement of shoulder backing (i.e., rolling loose gravel for
shoulder); and (5) Utility cover adjustments. Road surface treatment projects may occur on major arterial
or commuter routes. If so, the contractor will be instructed to work only during non-commute hours so as
not to interrupt the flow of traffic, and will phase the work if necessary to minimize disruption to motorists.
In residential areas the majority of work will be performed during the hours of 7:30 a.m. and 5:00 p.m.
Subject Location: The road surface treatment projects may occur on unincorporated roadways in Contra
Costa County.
This project is exempt from CEOA as a:

The 1994 road surface treatment projects consist of routine maintenance activities on existing road surfaces
and will not result in any expansion of use beyond that previously existing. No removal of scenic resources
will occur as a result of the activities.

SUBJECT: MANDATORY REFERRAL FOR GENERA.L (PLAN CONFORMANCE
Community Development staff has reviewed the attached project, CP 94- `s to determine
if mandatory referral for General Plan Conformance, as required by Section 65402 of the
Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:
(� This project has been determined to be exempt from. 65402 review.
( ) This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because the
project involves a road alignment project of a minor nature.
( ). This project should be referred to the City of for 65402 review.
( ) Community Development staff makes the following attached recommendation
which should be incorporated into the staff report on this matter.
The project needs mandatory referral and County staff will process this project in the
following manner:
( 1 65402 review is required. Community Development staff will carry this matter
before the appropriate Planning Commission.
( ) 65402 review must be withheld until completion of an Environmental Impact

Road Surface Treatmentsl. In conformance with Contra Costa County Guidelines for implementing the California
Environmental Quality Act of 1970 (CEQA), it has been determined that your project will not have a significant
effect on the environment. Your project falls within the following category:
(✓) AN ENVIRONMENTAL IMPACT REPORT (EIR) IS NOT REQUIRED.
(✓) The project is categorically exempt (Class 1c I.
l ) The CEQA requirements are accommodated by the EIR previously prepared for
( ) A statement that an EIR is not required (Negative Declaration of Environmental Significance has
been filed by the Community Development Department (unless appealed).
