In lieu of retroactive pay, the employee will receive a lump sum payment computed as follows: Employee's regular pay and overtime.pay and specific other earnings ordinarily computed as a percentage of base pay will be added together for each applicable pay period to determine the Retro Pay Base. This Base will then be multiplied by 3%to arrive at the employee's lump sum payment. This computation will be for_ pay periods beginning August 1, 1993 through February 28, 1994. The payment amount thus computed will be added.to the employee's paycheck where it will be listed separately as a LUMP SUM PAYMENT and will be subject to normal tax withholding and retirement deduction requirements. Bob Gordon and Nancy Rampani. Both agreed to the COLA deferral. After Mr. Gordon's resignation, via Board Resolution in June 1993, the District Court Manager position at Bay Court was downgraded to the level of District Court Manager B, retitled District Court Manager II. (The Bay Court position had been maintained at the A level because of Mr. Gordon's status as Clerk-Administrator prior to the administrative consolidation of municipal courts in this county.) The new District Court Manager II position at Bay Court was filled in late August via the appointment of Sharol Strickland, previously Court Operations Coordinator at the Walnut Creek-Danville Court. Board Resolution 94/52 specifically addresses salary increases for department heads. The District Court Manager II at Bay Court is not a department head position, and is no longer filled by an employee with department head status, which is why I called to have this class and District Court Manager I deleted from the Board Resolution. However, the class of District Court Manager II should get the 3% October 1992 COLA, which has already been given to the District Court Manager I class. The pay increase is also needed to maintain the appropriate salary differentials between the three District Court Manager classifications. My first thought is that .the salary increase should be retroactive to August 1993, when Ms. Strickland assumed the position, which I believe would have to be accomplished via P300 action. This appears to be more efficient than to correct the inequity via an amendment to Board Resolution 94/52, especially because of the issue of retroactive pay for Ms. Strickland. I have attached a schematic of recent salary increases for the three District Court Manage" classes, as well as the appropriate salary docuiilentation from the i3Ouii0-1y's ('01iIE S system, which may further assist. in clarifying this salary issue.
