Resolution of Summary Vacation
(S. & H. Code § 8333)
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of a public service easement no longer required for storm drain
purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code,
commencing with Section 8333.
This vacation request is for a storm drain easement located in the Walnut Creek area. A
description of the area to be vacated is attached hereto as Exhibit "A" and incorporated herein by
reference.
This vacation request is for an easement which has been superseded by relocation and there
are no other public facilities located within the easement (S. & H. Code § 8333).
This conveyance request is part of a larger project for which a negative declaration covering
CEQA requirements was processed on October 2, 1990. The project has been determined to
conform to the County's General Plan.
This Board declares that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation. and exception described in attached Exhibit "A".
From and after the date this Resolution is recorded, the portion vacated no longer constitutes a
public service easement.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.

EXHIBIT "A"
A portion of lots 7, 8, 16 and a portion of the area designated as "Foxglove Lane" as shown on the
map of Subdivision 7490 Foxglove,"filed August 19, 1993 in Book 368 of Maps at page 15, records
of Contra Costa County, California, being all of the ten feet in width drainage easement granted to
Contra Costa County on November 1, 1955 accepted and recorded by Contra Costa County
November 30, 1955 in Book 2661 of Official Records at page 423 described as follows:
A ten feet in width drainage easement the centerline of which is described as follows:
Commencing at the most southerly corner of that certain parcel of land described in the Deed from
LT. Schreiber et ux to J. Taub, et ux, recorded in'Volume 807 of Official Records at page 198;
thence from said point of commencement north 53052' east along the southeasterly line of said
Taub parcel (807 OR 198) 11.56 feet, to the Point of Beginning of said strip of land; thence from
said Point of Beginning northwesterly along the arc of a curve to the left with a radius of 50.00 feet,
the center of which bears south 5503459"west from said point, an arc distance of 24.62 feet; thence
tangent to the last mentioned curve north 62038' west 157.29 feet, parallel and 15.00 feet easterly
measured at right angles from the southeasterly line of said Taub parcel (807 OR 198), to the
northwesterly line of said Taub parcel (807 OR 198), the point of terminus of said strip of land.
This real property description has been prepared by me or under my direction, in conformance with
the Professional Land Surveyors Act.
