SUBJECT: EMPIRE AVENUE BRIDGE REPLACEMENT - OAKLEY AREA

SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated January 14, 1994, from
William T. Milleman, III, Inc., and Midan Development, Inc.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $8,750 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Chicago Title Insurance Company,
500 Ygnacio Valley Road, Ste 200, Walnut Creek, Ca., 94596, Escrow No. 75484 to be
forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $8,750.00 from Oakley Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Empire Avenue Bridge Replacement project in
accordance with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in the northwest quarter of the northwest quarter of Section 35, Township 2 North,
Range 2 East, Mount Diablo Meridian, Contra Costa County, Califomia, being portions of that parcel
of land described in the deed to William T. Milleman III and Midan Development Inc. recorded
December 20, 1989 in Volume 15552 of Official Records at page 802, described as follows:
Commencing in the intersection of Empire Avenue and Laurel Road at the iron pipe marking the
northwest corner of Section 35 (T2N, R2E); thence along the north line of Section 35, south
89°24'00" east 465.00 feet; thence south 0042'45" west 44.89 feet to the Point of Beginning at the
northwest comer of said Milleman parcel (15552 O.R. 802); thence from the Point of Beginning
along the north line of said parcel, also being the south right of way line of Laurel Road, south
89°24'4T'east 233.09 feet; thence leaving said common line, south 0036'00"west 65.16 feet; thence
north 89024'00" west 233.22 feet to the west line of said Milleman parcel; thence along said west
line, north 0°42'45" east 65.11 feet, to the Point of Beginning.
