SUBJECT: Hearing On The Administrative Appeal of Kim Verissimo
Relative to The Decision Of The Health Services
Department For A New Dwelling At 90 Orchard Estates
Drive, Walnut Creek.
On September 14, 1993, the Board of Supervisors continued to
this date the hearing on the administrative appeal of Kim
Verissimo from the decision of the Health Services Department,
Environmental Health Division, relative to water and sewage
disposal for a new dwelling at 90 Orchard Estates Drive, Walnut
Creek.
Victor Westman, County Counsel, commented on a memo to the
Board of Supervisors dated' March 9, 1994 and advised that the
matter should be referred by the Clerk of the Board to the City
Council of Walnut Creek for disposition since they have
jurisdiction in .the matter.
IT IS BY THE BOARD ORDERED that the appeal on the above
matter be REFERRED by the Clerk -of the Board to the City of
Walnut Creek.'

NOTICE OF PUBLIC MEETING AND AVAILABILITY OF DATA
The Contra Costa County Board of Supervisors will hold a public meeting on Tuesday,
March 15, 1994, at 11:00 a.m. in the Board of Supervisors Chambers, County
Administration Building, 651 Pine Street, Martinez, California,to consider an increase to the
criminal justice administrative fee relating to the booking and other processing of arrestees
into the County detention facility. Oral and written presentations on the increased fee will
be considered at the meeting.
At least ten (10) days prior to March 15, 1994, data indicating the proposed fee, the cost or
estimated cost of providing the services for which the fees will be levied, and the revenue
sources anticipated to provide the services, will be on file in the office of the Clerk of the
Board of Supervisors, located at the above address, Room 106, and will be available there
for public inspection. Names of persons to contact for more information about specific fees
will also be on file.

Re: Appeal of Kim I . Verissimo from Health Officer Administrative
Decision of May 26, 1993
The above-entitled appeal was originally scheduled to be heard
by the Board of Supervisors on July 27, 1993 . It was continued to
March 15, 1994, in order to give the Health Department and the City
of Walnut Creek an opportunity to negotiate a resolution with the
Verissimo family. This appeal involves the adequacy of an on site
septic system and water well to permit occupancy of the dwelling.
On December 14, 1993, the Board adopted Ordinance No. 93-84
which amended sections 414-4 . 1017 and 420-6 .513 of the County
Ordinance Code to provide that appeals from health officer decisions
. which affect property located entirely within a city shall be
directed to the appropriate city council, instead of to the County
Board of Supervisors. The amendment applies to all pending appeals .
(Section IV of Ordinance No. 93-84 . )
Accordingly, ' the Board should refer the Verissimo appeal to
the Walnut Creek City Council since the property at issue is located
in the city of Walnut Creek and at all times pertinent, the county
health officer was functioning as the city health officer.
