SUBJECT: EMPIRE AVENUE BRIDGE REPLACEMENT PROJECT - OAKLEY AREA

SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated February 17, 1994,
from Contra Costa Water District.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $18,950.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Chicago Title Insurance Company,
500 Ygnacio Valley Road, Suite 200, Walnut Creek, Ca., 94596, Escrow No. 75485, to be
forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $18,950.00 from Oakley Area of Benefits funds.
Ill. Reasons for Recommendations and Background:
These property rights are required for the Empire Avenue Bridge Replacement project-in
accordance with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in the northeast quarter of the northeast quarter of Section 34, Township 2 North,
Range 2 East, Mount Diablo Meridian, Contra Costa County, California, being portions of that parcel
of land described in the deed to Contra Costa Water District recorded March 3, 1992 in Volume
17278 of Official Records at page 556, described as follows:
PARCEL 2: (Fee Title)
Commencing in the intersection of Empire Avenue and Laurel Road at the iron pipe marking the
northeast corner of Section 34 (T2N, R2E); thence along the north line of Section 34, north 88059'22"
west 22.50 feet; thence south 0°43'21"west 22.50 feet to the northeast corner of said Water District
parcel (17278 O.R. 556), the Point of Beginning; thence from the Point of Beginning along the east
line of said Water District parcel, also being the west right of way line of Empire Avenue, south
0°43'21"west 408.78 feet;thence leaving said common line, north 11 054'52"west 221.52 feet; thence
north 0°28'11" west 145.41 feet; thence north 8739'56" west 216.42 feet; thence north 82058'1 T'
west 290.92 feet to a point hereinafter referred to as Point "A" on the west line of said Water District
