SUBJECT: E. CYPRESS ROAD AT SELLERS AVENUE INTERSECTION
IMPROVEMENTS - OAKLEY AREA

SPECIFIC REQUEST(S ) OR RECOMMENDATION( ) BA K ROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated February 23, 1994,
from Bernice M. Hoyt, et. al.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $900.00 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Bernice M. Hoyt, Joan A. Dummer
and Berton.R. Dummer, P.O. Box 1299, Oakley, Ca., 94561, to be forwarded to the Real
Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $900.00 from Oakley Area of Benefits funds.
III. Reasons for Recommendations and Background:
These property rights are required for the E. Cypress Road at Sellers Avenue Intersection
improvement project in accordance with the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Real property in the unincorporated area of Oakley, Contra Costa County, California, being a portion
of the southeast quarter of Section 30, Township 2 North, Range 3 East, Mount Diablo Meridian,
described as follows:
A portion of PARCEL ONE described in the deed to Bernice M. Hoyt and Joan A. Dummer recorded
December 26, 1989 in Volume 15561 of Official Records at page 648, described as follows:
Beginning on the south right of way line of East Cypress Road at the east line of said PARCEL ONE
(15561 O.R. 648); said Point of Beginning bears north 89°17'21"west 328.68 feet and south 1021'54"
west 30.00 feet from the Contra Costa County monument marking the east quarter corner of said
Section 30; thence from the Point of Beginning along the east line of said PARCEL ONE, south
1021'54"west 5.00 feet; thence leaving said east line, north 89017'21" west 66.24 feet; thence north
88029'36"west 264.79 feet, to the west line of said PARCEL ONE; thence along said west line, north
0042'39"east 1.32 feet,to the south right of way line of East Cypress Road; thence along said south
