SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated October 21, 1993 from
Kristen Marie Anderson.
B. AUTHORIZE Public Works Director to execute said Right of Way Contract on behalf of
the County.
C. APPROVE payment of $145,000 for said property rights and AUTHORIZE the Auditor-
Controller to issue a check in said amount payable to Chicago Title Company, 590
Ygnacio Valley Road, Suite 300, Walnut Creek, Ca., 94596, Escrow No. 000076040 to be
forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above referenced Grant Deed recorded
in the office of the County Recorder.
II. Financial Impact:
Payment of $145,000 from Oakley Area of Benefit funds.
III. Reasons for Recommendations and Background:
These property rights are required for the Empire Avenue Widening project in accordance with
the approved plans and specifications.
IV. Consequences of Negative Action:
The project will not have sufficient land rights to allow construction in accordance with the
approved plans and specifications.

Meridian, described as follows:
Beginning on the east line of the parcel of land described in the deed from Ben E. Mc
Clelland, et ux, to Billy F. Cleveland, et ux, recorded October 4, 1955, in Book 2622 of
Official Records, page 589, distant thereon south 100 feet from the northeast corner
thereof; thence from said Point of Beginning, west 135 feet; thence south 89 feet; thence
east 135 feet to the east line of said Cleveland parcel (2622 OR 589); thence north along
said east line, 89 feet to the Point of Beginning;
Excepting therefrom, the land described in deed from James W. Anderson and Marie
