RECOMMENDED ACTION: APPROVE Addendum#2 to the Final Environmental Impact Report(FEIR)for the Alamo Estates Subdivision Project evaluating dedication of 4.4 acres to use as a neighborhood park. II. FINANCIAL IMPACT: The estimated contract cost of the park is $650,000, funded by County Service Area (100%) R- TA Alamo funds. III. REASONS FOR RECOMMENDATION/BACKGROUND: The Addendum #2 includes evaluation of the dedication of 4.4 acres for use as a neighborhood park and its facilities.. The Addendum #2 is consistent with County policies and does not lead directly or indirectly to significant physical changes in the project, nor does it alter the adequacy or completeness of the environmental impacts and mitigation measures identified in the FEIR. Therefore, an Addendum to the FEIR is appropriate to address the minor technical changes in the project description. Upon County approval, Addendum #2 would be attached to the FEIR for the Alamo Estates Subdivision project. The DEIR discussed the inclusion of a 3.5 acre community park in the subdivision project, and the Addendum reverted the park site back to residential lots. That Addendum is no longer valid. This document serves as Addendum #2 to the FEIR for the Alamo Estates Subdivision Project and evaluates the dedication of 4.4 acres for use as a neighborhood park and its facilities. Consequently,the FEIR for the project consists of the DEIR, comments received on the DEIR, a list of all commenters on the DEIR, responses to the comments raised, and Addendum #2. The Contra Costa Community Development Department (CDD) is the lead agency for the project, and on August 5, 1992, the Board of Supervisors.approved the project and filed a Notice of Determination with the County Clerk. The Board acknowledged that the project would have certain environmental effects and adopted the findings as expressed in the San Ramon Valley Regional Planning Commission Resolution No.46-1992. The Resolution was certified on August 5, 1992. In addition, the Board recognized future land use and hydrology; traffic and circulation; water quality; wildlife and vegetation; geology and soils; and earthwork; noise; air quality; cultural resources; and growth inducement impacts would be reduced to insignificant levels if proposed and recommended measures were followed. CEQA PROCESS The California Environmental Quality Act (CEQA) prescribes that an Addendum (CEQA Guidelines Section 15164) to an environmental impact report (EIR) shall be prepared by either the lead agency or the responsible agency if: 1. None of the conditions described in CEQA Guidelines Section 15162 have occurred: 1 a. No substantial changes have occurred which will introduce new or - significant changes or environmental impacts not previously considered; b. Nc�',significant changes to the conditions or circumstances in the area affected by the project have occurred, such as substantial deterioration in air quality; c. No new information has become available which shows that significant impacts previously examined will be substantially more severe than shown in the EIR or the project will have one or more significant effects not previously discussed. 2. Only minor technical changes or additions are necessary to make the EIR under consideration adequate under CEQA; and, 3. The changes to the EIR made by the Addendum do not raise important new issues about the significant effects on the environment. In accordance with CEQA Guidelines Section 15164(c), the County Board of Supervisors must consider Addendum #2 along with the FEIR prior to making a decision on the project. According to CEQA Guidelines Section 15164 (b) an Addendum does not require circulation for public review but can be included in or attached to the FEIR. As noted in the Preface, Addendum #2 is attached to the FEIR for the Alamo Estates Subdivision Project (State Clearinghouse # 91033039) EXPLANATION OF ADDENDUM Addendum #2 to the FEIR for the Alamo Estates Subdivision Project identifies the need for the dedication of 4.4 acres of land for a neighborhood park per the subdivision's Conditions of Approval (August 5, 1992). Project Description: The DEIR indicated a 3.5 acre community park with improvements would be included in the project. The FEIR states the acceptance of an Offer of Dedication by the County for a 4.4 acre neighborhood park site. The proposed park site has been designed for use as a neighborhood park in accordance with the County General Plan, #9 -Open Space Element (Park and Recreational Facilities Goals & Policies). A well will be drilled for irrigation purposes and will be subject to the requirements of the County Health Department. 2 The proposed project features are: 1. Sport court (70'x30'), night lights are not proposed. 2. Picnic facilities. 3. Play area. V 4. Parkin'g' lot. 5. Walking paths. 6. Landscaping plantings. 7. Rest rooms and storage building. 8. A low level security lighting system. Addendum #2 is consistent with County policies and does not lead directly or indirectly to significant physical changes in the project, nor does it alter the adequacy or the completeness of the environmental impacts identified in the FEIR. Therefore, Addendum #2 to the FEIR is appropriate. The construction and safety specifications will be subject to the requirements of the County Health Department. 4th paragraph, after the 2nd sentence, add: The installation of low level security lighting will illuminate the park's perimeter thereby minimizing any safety risks to nearby residents. p. 154, 2nd paragraph, 3rd sentence, change: The project will supply 96 a maximum of 93 additional housing units... 6 RESOLUTION of the SAN RAMON VALLEY REGIONAL PLANNING COMMISSION, STATE OF CALIFORNIA, INCORPORATING FINDINGS and RECOMMENDATIONS PERTAINING to the FINAL ENVIRONMENTAL IMPACT REPORT for the ALAMO ESTATES SUBDIVISION RESOLUTION NO, 46.1992 The Findings for the Alamo Estates Subdivision were made by the San Ramon Valley Regional Planning Commission to comply with Section 15091 of the CEQA Guidelines and are incorporated herein by reference. 7 CONTRA COSTA COUNTY ADDENDUM FINDINGS for the FINAL ENVIRONMENTAL IMPACT REPORT for the ALAMO ESTATES SUBDIVISION PROJECT The following information is presented to comply with Section 15091 of the CEQA Guidelines for the FEIR for the Alamo Estates Subdivision. 1. Environmental Effect: The project will result in the acceptance of an Offer of Dedication of 4.4 acres of land and construction of a neighborhood park facility. Findings: There are no significant environmental impacts associated with this park site dedication for which Addendum #2 was prepared. The park site with the addition of a 16-18 space parking lot, paved access, and other features are not considered significant impacts. Minor technical changes to the design of the project do not cause a significant impact that was not previously identified in the FEIR for the Alamo Estates Subdivision. STATEMENT OF FACTS: a. The project to be developed pursuant to Addendum #2 to the 'FEIR for the Alamo Estates Subdivision Proiect is identical, or substantially similar,to the project analyzed in the FEIR. b. The FEIR for the Alamo Estates Subdivision Project consists of the DEIR, comments received on the DEIR, a list of all commenters on the DEIR, responses to the comments raised, and Addendum #2. The FEIR was completed in compliance with CEQA. c. There are no subsequent changes, pursuant to CEQA Guidelines Section 15162 (a) (1) in the project which require important revisions of the FEIR because the project is identical, or substantially similar, to the project analyzed in the FEIR. d. There are no substantial changes in the circumstances, pursuant to CEQA Guidelines Section 15162 (a) (2), under which the Alamo Estates Subdivision Project will be undertaken. Those circumstances remain identical or substantially similar to the circumstances analyzed in the FEIR. e. There is no new information of substantial importance, pursuant to CEQA Guidelines Section 15162 (a)(3), to the Alamo Estates Subdivision Project which could not have been known when the FEIR was originally certified by the Board of Supervisors August 5, 1992, and which shows that the project will have one or more significant effects not discussed in the FEIR, or which shows that significant effects previously analyzed will be substantially more severe. 8 f. None of the conditions calling for the preparation of a subsequent or supplemental EIR have occurred (see items 1 c - e above). Therefore, it is appropriate to adopt Addendum #2 to the FEIR. The changes to the FEIR made by the proposed Addendum #2 do not raise important new issues about significant e#ects on the environment. Addendum #2 shall be considered along with the FEIR prior to the Board of Supervisors making a decision on the dedication of the site. The findings are supported by substantial evidence in the administrative record and are based on the FEIR for the Alamo Estates Subdivision Project which was subject to public review. ti :jf c:alamo.add f. 9
