SUBJECT: Positions on Transportation-Related Legislation
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Adopt the following positions on transportation-related legislation
currently before the Legislature:
AB 1212 (Rainey) Congestion Management Programs Amend
ACR 31 (Lee) Bay Bridge Rail Service Amend
SB 1095 (Killea) Nonmotorized Transportation Support
SCA 10 (Marks) Motor Vehicle Fuel Tax Oppose
FISCAL IMPACT
If passed, Senate Constitutional Amendment 10 could have a negative
impact on County gas tax revenues by diverting funds from highway
and transit purposes for other uses.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The Transportation Committee has reviewed a number of
transportation-related bills currently in the State legislature and
recommends the Board adopt positions as indicated above. A brief
discussion of each bill and the reasons for the Committee's
position is presented below. The Committee will continue to
monitor bills and may make further recommendations to the Board.

Assembly Bill 1212 (Rainey)
This bill would require each congestion management agency in the state to
include full voting membership by transit districts or authorities in the
County. In Contra Costa, the Contra Costa Transportation Authority has been
designated as the congestion management agency. The Authority board consists
of 11 voting members, two from each regional transportation planning committee,
two from the Board of Supervisors, and one from the Conference of Mayors. The
County is served by five transit agencies (BART, AC Transit, County Connection,
Tri-Delta Transit, and West County Transit) . The Committee believes that it is
important that transit be represented on the Congestion Management Agency, but
that this representation should consist of one voting member, to be selected by
the transit agencies. The bill should be amended to require one voting member
representing transit on the congestion management agency.
Assembly Concurrent Resolution 31 (Lee)
ACR 31 directs the Metropolitan Transportation Commission to study the
engineering and operation issues involved in re-establishing rail transit on the
San Francisco Bay Bridge. A report is to be issued to the Governor and
Legislature by July 1994 . The bill lists a number of planning efforts that this
study should coordinate with. The Committee recommends an amendment to this
requirement to include the Greater East Bay Rail Opportunities Coalition
(GEBROC) as one the planning efforts that the study coordinates with. MTC's
position on the bill is "monitor" .
Senate Bill 1095 (Killea)
This bill would consolidate, upgrade and strengthen the bicycle planning and
operations activities of Caltrans. It would create a bicycle facilities
coordinator within the Department, require preparation of a statewide bicycle
map, and require submittal of an annual report on bikeway development to the
Legislature. Essentially, the bill establishes the bicycle as one of the modes
of transportation for which the state has responsibility. The Committee
recommends a support position by the County.
State Constitutional Amendment 10 (Marks)
SCA 10 would remove the existing constitutional restrictions on uses of motor
vehicle fuel tax revenues for gas tax increases above the per gallon rate in
effect on December 31, 1994. At present those revenues may only be applied for
specified street, highway, and transit purposes. The Committee recommends that
the County oppose this legislation. MTC also opposes this bill.
