SUBJECT: Opposition to Proposed Amendments to AB 51 Addressing Regional Housing
Needs
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
OPPOSE amendments to AB 51 proposed by the State Housing and Community
Development Department; and AUTHORIZE the Chair to sign letters to the
County' s legislative delegation stating this position.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
AB 51 has been introduced to amend state .housing law to permit cities
and counties to undertake joint affordable housing activities and
receive a fair share credit for meeting a portion of their housing

BY , DEPUTY
(HCD) has proposed several amendments to AB 51 which would
effectively shift final authority for decisions concerning local
housing development from cities and counties to HCD. If
successful, the HCD amendments will :
o Require local Council of Governments to allocate multifamily
zoning and density standards to jurisdictions in their region.
o Require jurisdictions to meet HCD approved density standards
to obtain Housing Element approval .
o Prohibit . jurisdictions from disapproving housing projects
without an HCD-approved Housing Element.
o Create a Housing Appeals Board to allow developers to appeal
project denials to representatives of HCD, the Office of
Planning and Research, and others .
o Create a presumption that a jurisdiction' s General Plan is
invalid if HCD will not approve its Housing Element.
o ' Allow HCD to establish performance objectives .for low-income
housing in each California jurisdiction.
o Require the reduction or deferral of development fees for
affordable housing with no state funding to offset direct or
indirect service costs .
Contra Costa County is a member of the Tri-Valley Affordable
Housing Committee which was created as a subcommittee of the Tri-
Valley Council for purposes of identifying affordable housing needs
and potential cooperative approaches to meeting those needs in the
Tri-Valley area. In addition to Contra Costa County, the Committee
includes representatives from Alameda County and the cities of
Livermore, Pleasanton, Dublin, Danville, and San Ramon. The
Committee has asked participating jurisdictions to prepare letters
to their legislative delegation recommending opposition to the HCD
amendments .
