THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on July 13, 1993 by the following vote:
AYES: Supervisors Powers, Smith, Bishop, McPeak and Torlakson

SUBJECT: Discharge Public Works Indemnity Accounts (0672-6U5600) From
Accountability for Collection
AUTHORIZE discharge from accountability for collection of the following obligations on
the grounds either that the statute of limitations has been exceeded, that a Small Claims
judgment was entered against the County, that the debtor has filed a bankruptcy and it
has been discharged by the Court, or that the responsible party is undetermined.
Delete 41 accounts and a total of$21,884.82 from the Public Works Accounts Receivable
Road Fund maintenance budget (see attached listing of accounts). This amount consists
of: A) 32 Accounts for $16,750.71 which have exceeded the statute of limitations (SL);
B) 4 accounts for $2,087.01 because a judgment was entered against the County (LJ);
C) 3 accounts for $987.95 because the debtor filed for and was granted a discharge of
bankruptcy (BA); and D) 2 accounts for $2,059.15 because the department was unable
to determine the responsible party to bill (NR).
Most of these accounts represent damage to County property from auto accidents.
These accounts represent ongoing attempts to collect money primarily due the County
Road Fund for incidents going back as far as 1985.
These accounts were handled by the Office of Revenue Collection (ORC) until April 1992,
when they were transferred back to the Public Works Department. Billing was sent each
to each person until it became obvious they were unwilling to pay. We are unable to
pursue the collection of the listed amounts for the following reasons: A) The statute of
limitations of three years from the incident date, or date of last payment has been
exceeded, and the County has no legal recourse in the pursuit of the accounts. B) The
accounts were taken to Small Claims court and judgment was against the County. There
is no right of appeal and the accounts cannot be pursued any further. C) The
bankruptcy accounts had not been deleted from the ORC run and were therefore
transferred as active. When the bankruptcy was discovered, billing was stopped. The
County has no legal recourse for collection of these accounts. D) It was impossible to
clearly determine who was responsible for the bill.
