HomeMy WebLinkAboutMINUTES - 06081993 - S.2 5.2 to: BOARD OF SUPERVISORS ...�, Contra FROM: / Costa Supervisor Tom Torlakson :r County DATE` June 8, 1993 ` t SUBJECT: CONSIDER STIPULATIONS FOR COUNTY'S ACCEPTANCE OF COMMUNITY DONATED SHERIFF'S ANNEX STATION IN DISCOVERY BAY SPECIFIC REGUEST(S)OR RECOMMENDATION(S)8 BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: Refer to the Sheriff's Department and the General Services Department (Lease Management) to review the formal procedure for the county's acceptance of a donation of a trailer to the Sheriff ' s Department by the Discovery Bay Property Owners Association and the stipulations outlined in a "Gentleman' s Agreement" developed by the Board of Directors of the Discovery Bay Property Owners Association as to the use of this trailer. BACKGROUND INFORMATION: The Board of Directors of the Discovery Bay Property Owners Association presented to me a "Gentleman"s Agreement" outlining stipulations as to the use of the trailer donated to the Sheriff ' s Department. I was invited to attend the rededication of this trailer but due to previous commitments was unable to attend for the formal signing of this agremeent. In reviewing this agreement and after discussion with Al Snell of the Sheriff' s Department, I determined that the Sheriff ' s Department has not formally accepted this trailer which has been reinstalled in the parking lot of the the East Diablo Fire District station in Discovery Bay. After determining the appropriate procedure for formally accepting this donation, I recommend that the Board of Supervisors to officially acknowledge and express appreciation to the Discovery Bay citizens for this generous donation and community spirit. Al Schell Sheriff Warren Rupf Chief Paul Hein FROM: Discovery Bay Property Owners' Association Board of Directors SUBJECT: DISCOVERY BAY SHERIFF'S-ANNEX STATION The citizens of Discovery Bay, with community spirit and generosity have paid for the procurement of, and installation of the sheriff's annex station. Some concerns have been voiced as to the present and future status of the trailer. To appease these concerns, we have made a list of stipulations as to the use of the trailer that we hope you will agree too. This will be formally known as a "Gentleman's Agreement," amongst all concerned parties. 1. For all intended and legal purposes, the trailer is owned by, and for the sole use by, the Contra Costa County Sheriff's Department. 2. The trailer will never be removed from Discovery Bay for use outside of this community. 3. The trailer will remain at it's present spot and location (Fire Station No. 58) until such time the Sheriff's Department deems they no longer need or have use for the trailer. 4. If the Sheriff's Department deems they no longer need the trailer, it will be donated back to the Discovery Bay Property Owners' Association, Inc. for relocation and use elsewhere within the community if deemed necessary by the county. In the spirit of cooperation and for the benefit of the citizens of Discovery Bay, we sincerely hope you agree to the stipulation in this "Gentleman's Agreement." We would like to have a formal signing of this Agreement at the Re-dedication Ceremony on May 8 at 9:00 a.m. I hereby agree to the stipulations set forth in the "Gentleman's Agreement." Dated
