Recommended Action: APPROVE the Amendment to the Cooperative Agreement with the Contra Costa Water District, dated October 1, 1986, to continue to September 30, 1996, for the collection of rain and stream gauge data and AUTHORIZE Chief Engineer to execute the Amendment. II. Financial Impact: The total costs of the data collection program for the five year period, from October 1, 1991, to September 30, 1996, is as follows: Period Cost Oct. 1, 1991 - Sept. 30, 1993 $37,000 Oct. 1, 1993 - Sept. 30, 1994 19,000 Oct. 1, 1994 - Sept. 30, 1995 20,000 Oct. 1, 1995 - Sept. 30, 1996 20,000 Total $96,000 The Amendment provides for the Contra Costa Water District to make full payment at the beginning of each period. No financial impact to the County. Reasons for Recommendations and Background: Since 1986, the Contra Costa County Flood Control and Water Conservation District has collected rainfall and stream flow data for the Contra Costa Water District's proposed Los Vaqueros (Kellogg Creek) reservoir project. The Flood Control District benefits by having the data for use in our Kellogg Creek rainfall-runoff study and in our database for the Countywide hydrology system. Contra Costa Water District benefits by having the data for the design and construction of the Los Vaqueros reservoir. IV. Consequences of Negative Action: If the agreement is not amended to continue, the District will lose the opportunity to continue a mutually beneficial data collection program as well as the loss of a cooperative effort by two public agencies. The Contra Costa Water District would further be affected by having to hire an outside engineering firm at a considerable increase in cost to the Water District. AMENDMENT TO AGREEMENT BETWEEN CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT AND CONTRA COSTA WATER DISTRICT 1. Effective Date and Parties - Effective October 1, 1991, the Contra Costa County Flood Control and Water Conservation District(herein called "FLOOD CONTROL DISTRICT"), a political subdivision of the State of California,and the Contra Costa Water District(herein called"WATER DISTRICT"),a public corporation,mutually agree as follows: 2. E -The parties mutually agree to amend the agreement they entered into on October 1, 1986 and amended on October 1, 1988. The original agreement covers the collection and reporting of streamflow and precipitation data in the Kellogg Creek Watershed for the period of October 1, 1986 through September 30, 1989. The amendment of October 1, 1988 extended the agreement through September 30, 1991 and added the collection and reporting of meteorological data at Marsh Creek Reservoir. The purpose of this amendment is to extend the agreement for an additional five years and to clarify the services to be performed by the FLOOD CONTROL DISTRICT. 3. Metes-Section III"Method"Subsection 11"is amended and shall read: H. The FLOOD CONTROL DISTRICT shall operate and maintain its equipment used in the performance of this agreement to the standards outlined in the publication "National Handbook of Recommended Methods for Water-Data Acquisition" to produce: evaporation in inches per day; mean daily, maximum and minimum air temperatures in degrees Centigrade; mean daily, maximum and minimum relative humidity(0-1009'0); mean daily,maximum and minimum wind speed in miles per hour and mean daily wind direction (0-360 degrees)at Marsh Creek Reservoir. 4. Pa=ent Reimbursement - Section IV, "PAYMENT AND REIMBURSEMENT" is amended to read: IV. PAYMENT AND REIMBURSE : THE WATER DISTRICT shall pay to the FLOOD CONTROL DISTRICT the sum of$184,000 as and for compensation for the services described in Section M. Effect of Amendment-Except as specifically modified by this amendment,all provisions of the above described agreement (as modified by the Amendment to Agreement effective October 1, 1988) shall be unaffected by this amendment and shall remain in full force and effect.
