MICHAEL WALFORD, CHIEF ENGINEER DATE: June 8, 1993 SUBJECT: Approve Agreement with East Bay Municipal Utility District for Temporary Landscape _ Water Service for the Walnut Creek Wildlife Mitigation Project Project No: 7520-6B8616 Specific Request(s) or Recommendations) & Background & Justification 1. RECOMMENDED ACTION. APPROVE an agreement with East Bay Municipal Utility District for landscape water service, and AUTHORIZE the Chief Engineer to execute the Agreement. II. FINANCIAL IMPACT: The East Bay Municipal Utility District has waived the$15,840 system capacity charge (SCC) for the water meter to be installed as part of the project. The Corps of Engineers will reimburse the Flood Control District for all but 7.4% of the other charges (installation charge of$4428 and the actual water usage). The 7.4% will be billed to Flood Control Zone 3B. III. REASONS FOR RECOMMENDATION/BACKGROUND: In 1983, the Corps of Engineers, the U.S. Fish & Wildlife Service and the California Department of Fish & Game determined that a total of 16.39 acres of riparian wildlife habitat would be required to mitigate loss of habitat associated with the federally authorized Walnut Creek Basin Flood Control Project. The current Corps of Engineers/Flood Control District mitigation project involves planting and temporary irrigation of 8.7 acres of the required 16.39 acres (7.7 acres on Upper Pine Creek in the Cities of Concord and Walnut Creek and 1.0 acres on Green Valley Creek in the Town of Danville). During the establishment period the plants must be irrigated. The East Bay Municipal Utility District has accepted Contra Costa County into the irrigation incentive program to help conserve water. Thus, the SCC will be waived. If for any reason the use of the irrigation system extends beyond a period of three (3) years after the completion of planting, the Flood Control District will pay the system capacity charge. IV. CONSEQUENCES OF NEGATIVE ACTION: Negative action taken by the Board will delay completion of the project and will require the Flood Control District to pay a higher cost to have the water meter installed.
