SUBJECT: REPORT ON THE CRIME LAB AND PATROL

RECOMMENDATIONS:
1 . Accept the Sheriff-Coroner's concept of putting the Crime Lab on a fee for
service basis and take initial steps to initiate this process.
2. Approve required appropriation and revenue adjustments as line item changes to
be made to the Adopted Proposed FY 1993-94 Budget to increase projected
revenue by the $500,000 agreed to by the Chiefs of Police.
3. Direct the County Administrator to monitor revenue realization and report to the
Board to the extent revenue is not realized to cover expenditures.
4. Authorize the County Administrator to restore eight Crime Lab Positions and
delaying the elimination of one position until September 30, 1993 through
approval of the attached Resolution, amending Attachment F to Resolution
93/327, approved May 25, 1993.
5. Continue to explore regional contracts with other jurisdictions to provide Crime
Lab services.
6. Accept report that reflects the efforts of the Sheriff-Coroner and County
Administrator to emphasize the importance of providing patrol services in the
unincorporated area of the County.

FINANCIAL IMPACT:
No net County cost effect on 1993-94 Proposed Budget. The following table
describes a summary of Crime Lab service costs:

Costs of the Crime Lab include the cost of: General Criminalistics, DNA Testing,
Rape Examinations, Drug Analysis, Drug Grant, Alcohol Testing, Toxicology,
Property, Fingerprint Services, and CAL-ID. Twenty-seven percent of the
$2,015,400 is for General Criminalistics, 24% is attributable to CAL-ID and half of
the City Contribution ($556,100) is from CAL-ID.
REASONS FOR RECOMMENDATION/BACKGROUND:
On May 25 the Board approved phase one reductions to the Crime Lab of 11
positions and $745,000. This amount represents a significant part of the cities' fair
share for their use of these non-mandated but important services. Immediately after
Board action, a memorandum was sent to all city managers informing them of this
action and stating that these reductions would be made at the close of business June
30, 1993. Subsequently, a committee of police chiefs asked for a meeting with the
County Administrator and Sheriff's Department to explore this issue.
At the time of the June 8 report to the Board it was not clear to what extent the
cities wished to contribute their fair share for support of the Crime Lab. They did
indicate, however, a desire to keep meeting to see how some city/county agreement
could be reached before the budget reductions took place.
Since that time the cities have agreed to pay $500,000 for Crime Lab services in
1993-94, which would leave a gap of $245,000 from the $745,000 cut in phase
one. Eliminating the vacant positions and holding the Supervising Criminalist vacant
will allow the County to save $171 ,000 leaving an unfunded gap of $74,000.
This gap of $74,000, from the Phase One cut, and the remaining unfunded balance
of $511 ,200 will be reviewed as part of the Phase Two County Budget cuts
necessitated by the State.
In addition, County Administrator staff will work with the Sheriff-Coroner to develop
a fee for service which will eventually cover all non-County Crime Lab costs incurred
($511 ,200). In the mean time, the line item changes to appropriations and revenues
will allow the Department to restore nine of the 11 positions to be eliminated from
the Crime Lab on June 30 (see Attachment). There is no effect on the Net County
Cost of the Department. The cost of the positions shown in the line item changes
are covered by the city contribution and savings from cancelled positions. County
Administrator staff will continue to monitor revenues with the Sheriff-Coroner.

REPORT ON PATROL
During the phase one budget deliberations on May 25, questions were raised about
the allocation of deputies to the unincorporated patrol function of the Sheriff's
Department. Questions were raised about how vacant positions are allocated
between various divisions of the department and the extent to which Sheriff's
deputies are utilized within the detention facilities to meet MOU staffing
requirements. In addition, a question was raised about the extent to which such
transfers are made between patrol and detention to save on overtime costs. The
County Administrator's Office asked the Department to explore these questions as
well as to look at such issues as: increased use of civilians to perform duties; the
extent to which departmental policies regarding transfers between detention and
patrol can be changed to maximize time spent on patrol duties; changes required in
the MOU to more effectively utilize existing deputy sheriff positions; and whatever
other methods the department can identify to maximize the use of sworn officers in
essential patrol functions within the constrains of authorized positions and budget
appropriations.
In the process of examining the allocation of deputies in the Sheriff's Department,
the Sheriff-Coroner and County Administrator have reviewed the three alternatives to
increase unincorporated patrol: filling the vacant positions now, waiting until the
Final Budget is adopted, and moving in-house deputies into Patrol.
Filling the vacant positions now is not an immediate solution. The selecting and
training process for a Deputy Sheriff takes a minimum of eight months. Hiring lateral
deputies would be unfair due to the unresolved budget situation and pending layoffs.
Waiting until the Final Budget is adopted solves the lateral transfer problem,
however, it is unclear when this will happen. Additionally, there are currently 16
vacant deputies and historically, about two to three deputy positions become vacant
each month. This means that the longer the wait, the worse the problem. Moving
in-house deputies into Patrol seems to be the only immediate solution.
The Sheriff will continue to take steps to utilize in-house deputies to the maximum
extent possible and keep the problem from growing further by beginning to replace
patrol deputy positions as they become vacant. However, because State cuts could
cause more reductions in the very near future, any steps taken to maximize patrol
and allow for a higher level of protection of the Counties streets could very well be
jeopardized. Therefore, the County Administrator is only authorizing action to keep
the status quo until Phase Two.
