MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: June 22, 1993 SUBJECT: APPROVE WAIVER OF DRAINAGE ORDINANCE NO. 1010 PERMIT FEE SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: AUTHORIZE the Public Works Director to waive the fee on the issuance of a Drainage Ordinance No. 1010 permit to Mr. Robert Brueckner, 2802 Kinney Drive, Walnut Creek. II. Financial Impact: The proposed action will decrease the Department's development revenue by approximately $600. III. Reasons for Recommendations and Background: On December 10, 1992, Robert and Lori Brueckner signed a "Full Release and Satisfaction of All Claims and Demands" statement with regards to their drainage claim against the County. The statement included a $2,500 cash payment to the Brueckners. We believe the resolution of the claim should have also included a "no cost" Ordinance No. 1010 permit for their completion of the corrective work to eliminate future flooding. IV. Consequences of Negative Action: The Brueckners will have to pay the permit fee.
