HomeMy WebLinkAboutMINUTES - 06151993 - D.5 Ps THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on June 15, 1993 , by the following vote: AYES: Supervisors Powers, Smith, Bishop, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Award of Contract for Clyde Park, Phase I, Port Chicago Highway, for County Service Area M-16, in the Clyde area Project No. 325-9201/B.4 . 1 Bidder Total Amount Bond Amounts Vic Sotto Landscaping, Inc. $77, 000. 00 Payment: 844 Las Lomas Drive (Base bid only) $38,500. 00 Milpitas, CA 95035 Performance: $77, 000. 00 Mori Hatsushi & Associates, Inc. Pacheco, .:CA Gateway Landscape Construction, Inc. Livermore, CA Riley & Sons Construction, Inc. Oakland, CA Siteworks Construction, Inc. Lafayette, CA The above-captioned project and the specifications therefor having been previously approved, Addendum No. 1 having been issued and approved, and bids having been duly invited and received by the Director of General Services on April 22, 1993 ; and The lowest monetary bidder, Golden West Environmental Services, Builders, General Contractors ("Golden West") , and the second lowest monetary bidder, Mork Brothers Landscape and Design Co. ("Mork") , having refused to extend their bids beyond the original forty-five-day period for acceptance and said bids having expired as a result; and The bidder listed first above, Vic Sotto Landscaping, Inc. ("Sotto") , having submitted the lowest monetary bid, which is $11, 550. 00 less than the next lowest bid; and The Contract Compliance Officer having reported that Sotto has attained MBE participation of 15. 6% and WBE participation of 0%, and the Board having considered the documentation of good faith effort submitted by Sotto; and The Director of General Services recommending that the bid submitted by Sotto is the lowest responsive and responsible bid, and this Board concurring and so finding; NOW, THEREFORE, the Board finds, determines and orders as follows: The Board DETERMINES that the bids submitted by the lowest monetary bidder (Golden West) and the second lowest monetary bidder (Mork) have expired and are no longer subject to acceptance; and i AWARD OF CONTRACT FOR CLYDE PARK, June 15, 1993 PHASE I, PORT CHICAGO HIGHWAY, FOR COUNTY SERVICE AREA M-16, CLYDE AREA The Board FURTHER DETERMINES that Sotto, as the lowest responsive and responsible bidder, has met or exceeded the MBE goal for this project (i.e. , 14%) and has demonstrated a good faith effort, pursuant to Public Contract Code Section 2000 and the specifications for this project, to comply with the WBE goal for this project (i.e. , 6%) and the requirements of the County's Minority and Women Business Enterprise Program, and the Board WAIVES any irregularities in such compliance; and The Board ORDERS that the contract for the furnishing of labor and materials for said work is awarded to Sotto at the listed amount (base bid only) and at the unit prices submitted in said bid, and that said contractor shall present two good and sufficient surety bonds as indicated above, and that the Director of General Services shall prepare the contract therefor; and The Board FURTHER ORDERS that after the contractor has signed the contract and returned it, together with the bonds as noted above and any required certificates of insurance or other required documents, and the Director of General Services has reviewed and found them to be sufficient, the Director of General Services is authorized to sign the contract for this Board; and The Board FURTHER ORDERS that in accordance with the project specifications and/or upon signature of the contract by the Director of General Services, any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and The Board FURTHER ORDERS that the Director of General Services is authorized to sign any escrow agreements prepared for this project to permit the substitution of securities for moneys withheld by the County to ensure performance under the contact, pursuant to Section 22300 of the Public Contract Code; and Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under Public Contract Code Sections 4107 and 4110 to the Director of General Services or his designee; and The Board DECLARES that, should the award of the contract to Sotto be invalidated for any reason, the Board would not in any event have awarded the contract to any other bidder, but instead would have exercised its discretion to reject all of the bids received. Nothing herein shall prevent the Board from reawarding the contract to another bidder in cases where the successful bidder establishes a mistake, refuses to sign the contract or fails to furnish required bonds or insurance (see Public Contract Code Sections 5100-5107) . We request that Golden West Environmental Services, Builders, General Contractors be awarded the subject contract with our original proposal plus $6, 000. for a total of $70, 431. 00. Golden West is the low bidder with this amount. I have discussed with Mr. Bender and Mr. Hill of the general services department that our original proposal was based on award of contract and performance of the work stated in the solicitation. Our original proposal was based on this time frame, and we discounted our proposal based on performing the work within the time frame of the solicitation. We wish to protest the award of the contract to any of the bidders who has a proposal higher than our adjusted proposal. The contract was not awarded within the time frame stated in the solicitation and if not awarded to Golden West should be rebid. In this time of difficult economics and concern for extending limited monetary resources, we feel it is in the best interest of the public to perform the work at the lowest possible cost.
