WHEREAS, Government Code Section 22790 provides for benefits of the Public Employees' Medical and Hospital Care Act (Act) to retired municipal and justice court judges;' and WHEREAS, Section 22825(b) of the Act provides that. a County shall fix the amount of the employer's contribution; and WHEREAS, Conta Costa County, hereinafter referred to as County; desires to obtain for its retired municipal and justice court judges the benefit of the. Act and to accept the liabilities and obligations of an employer under the Act and Regulations; now therefore, be it :RESOLVED, That the County elects, and it does hereby elect, to bq_ subject to the provisions of the Act; and be it further RESOLVED, That the County's contribution for each retired judge OR survivor shall be the amount necessary to pay, the full cost of his/her enrollment, including one dependant, in a health benefits plan at the same rate as the PERS single subvention rate with respect to retired judge or survivor and the same rate as the PERS "single plus om dependant" with respect to retired judge or survivor with one or more dependants; and be it further RESOLVED, And that County contributions for retired judges shall be in addition to those amounts contributed by 'the County for administrative fees and for contributions, if any, to the Contingency Reserve Fund; .and be it further Page 2 Resolution No. GI31390� 'RESOLVED, That the executive body appoint and direct, and it does hereby appoint and direct, Jean Soares, Employee Benefits Supervisor, to file with the Board of administration of the Public Employees ' Retirement System an original certified copy of this Resolution, and to perform on behalf of said County all functions required of it under the Act andRegulations of the Board of Administration; and� be 3t further RESOLVED, That coverage under the Act be effective on April, 1993. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. Recommendation: It is recommended that County Board of Supervisors elect to contract with PERS to administer the reimbursement of the County's employer contribution to retired municipal court judges or survivors who are enrolled in the Public Employee's Medical and Hospital Benefits Act (PEMHBA) . II. Financial Impact: Reduces the clerical costs associated with processing claims for reimbursement for medical benefits for retired judges or survivors. State will charge an administrative fee) which by statute cannot exceed 2% of the total monthly premium of enrolled retired judges. For the 92/93 contract year, the administrative fee is one-half of one percent ( .500%) . In addition, the state may assess a Contingency Reserve Fund Assessment fee which by law cannot exceed 4% of the total monthly premium. For the 92/93 contract year, the contingency reserve fund fee is zero percent (0.0%) . III. Background: The Brown-Presley Trial Court Funding Act (Senate. Bill 612, Chapter 945, Statutes of 1988) gave County Board of Supervisors the authority to provide retired municipal court judges health benefits substantially equal to benefits for retired superior court judges. On December 19, 1989, the Board passed Resolution Number 89/787, which extended the provision of Government Code Section 77208 to Municipal Court Judges providing retiree health benefits substantially equal to the retired benefits provided to superior court judges. Currently, the County reimburses the judges for the employer contribution by sending an individual check to each retired judge. The retired municipal court judge or survivor must present the County Municipal Court Administration Office with monthly or quarterly demands for reimbursement. A request for payment of the demands is sent by the Municipal Court Administration office to the Personnel-Benefits Division for review and approval for payment. The Auditor-Controller receives the approved request and issues individual checks to each retiree or survivor. Under the PERS program, the State would subvent the employer contribution, sending a monthly invoice to the county. IV.
