Background
The State Board of Equalization (SBE) assesses cellular telephone companies.
The local assessors have no role in such assessments. For some time, cellular
companies have disputed the methodology and valuation results of the SBE's
assessments. Several lawsuits have worked through the courts and several more are
about to be filed.
After considerable negotiation, the SBE has reached a tentative "global
settlement" agreement with the cellular companies on these issues, for prior years, the
current year, and future years through 1997-8.
Fiscal Impact
The settlement appears to us to be quite favorable. Under the settlement, the
Counties are expected to see a reduction in revenues only for 1993-4, and that
reduction should be modest. For subsequent years, assessments should be increased
from current levels. Significantly, if the Agreement is carried out through 1997-8, the
cellular companies will have waived all claims for refund of current and prior year taxes.
Thus, the possibility of refunding approximately $70,000,000 (Statewide) would be
avoided.
Recommendation
We recommend the Board approve the proposed settlement and authorize the
County Counsel's Office to sign all documents and take all actions necessary to
