Effective Date Pittsburg, California 94565 of This Revision:- ­APR 15 1993 102 Dear Mr. Torlakson: This is in response, to a letter dated 'December 24, 1992, from Mr. Nasser Shirazi, Acting Community Development Director, City of Pittsburg, regarding the effective Flood Insurance. Study and ,Flood Insurance Rate Map (FIRM) for Contra Costa County, California. In his Tetter, Mr. Shirazi requested that we .revise the effective FIRM for the City of Pittsburg to show changes to the 100-year floodplain boundaries as a result of the' installation of an -eight- foot by seven-foot" reinforced concrete .box culvert along Lawlor Creek in the City, from approximately . 1,400 feet. downstream to just upstream of Willow Pass Road. He also requested that we revise' the effective FIRM for .Contra Costa County to reflect the changes in the County's floodplain as a result of the installation of the box culvert. With a letter dated August 3, 1990, to Mr. Alfredo Hurtado of the City of Pittsburg Engineering Division, Mr. Robert D'. Agnew, Associate Civil Engineer, Contra Costa County Flood Control and Water Conservation District, concurred with the hydraulic analysis for the box culvert. All of .the data required to complete our review were submitted with Mr. Shirazi's December 24 letter. With a letter dated January 22, 1993, from Mr. Bill Morrison, Operations Manager, Kaufman and Broad of Northern California, Inc., we received the balance of the initial fee associated with this request for a Letter of Map Revision (LOMR). A conditional LOMR was issued for this project on January 8, 1992. All fees .necessary to process the LOMR, a total of $1,995, have been received. We have completed our review of the submitted data and the data used to produce the effective FIRM, and have revised the FIRM to modify the elevations. and floodplain boundary delineations of a flood having a 1-percent probability of being equaled or exceeded in any given year (base flood) along Lawlor Creek.. Base (100-year) flood elevations (BFEs) and the 100-year floodplain. area along Lawlor Creek have decreased from just upstream to approximately 850 feet upstream of Willow Pass Road. .The modifications are shown on the enclosed annotated copies of FIRM Panel 060025 0120 B, Flood Profile Panel 11P, and the Floodway Data Table for Lawlor Creek from the FIS report. This LOMR -hereby revises this panel of the effective FIRM dated July 16, 1987, and this Profile Panel, and the Floodway Data Table from the FIS report dated July 16, 1987. 2 Because this revision does not involve any floodway boundary changes, we are not enclosing an annotated Flood Boundary and Floodway Map (FBFM). Unless a subsequent physical map revision involves floodway changes for FBFM Panel 060025 0120, we will not revise it to show the changes made by this LOMR. Please note that a LOMR was issued on the same date as this LOMR to revise FIRM Panel 060033 0001 D for the City of Pittsburg, to show changes to the 100-year floodplain boundaries as a result of the installation of the underground box culvert. These modifications have been made pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (P.L. 93-234) and are in accordance with the National Flood Insurance Act of 1968, as amended (Title XIII of the Housing and Urban Development Act of 1968, P.L. 90-448), 42 U.S.C. 4001-4128, and 44 CER, Part 65. Public notification of modifications to the BFEs along Lawlor Creek will be given in the Pittsburg Post Dispatch on or about April 21, 1993, and April 28, 1993. In addition, a Notice of Changes will be published in the Federal Register. As required by the legislation, a community must adopt and enforce floodplain management measures to ensure continued eligibility to participate in the National Flood Insurance Program (NFIP). Therefore, your community must enforce these regulations using, at a minimum, the BFEs, zone designations, and floodways in the Special Flood Hazard Areas shown on the FIRM and FBFM for your community, including the previously described modifications. This response to your request is based on minimum floodplain management criteria established under the NFIP. Your community is responsible for approving all proposed floodplain developments, including this request, and for ensuring that necessary permits required by Federal or State law have been received. With knowledge of local conditions and in the interest of safety, State and community officials may set higher standards for construction, or may limit development in floodplain areas. If the State of California or Contra Costa County has adopted more restrictive or comprehensive floodplain management criteria, these criteria take precedence over the minimum NFIP requirements. 3 The community number and suffix code listed above will be used for all flood insurance policies and renewals issued for your community on and after the effective date listed above. The modifications described herein are effective as of the date of this letter. However, within 90 days of the second publication in the Pittsburg Post Dispatch, your community may request that we reconsider this determination. Any request for reconsideration must be based on scientific or technical data. All interested parties are hereby notified that, until the 90-day period elapses, the determination may be modified. This LOMR will not be printed and distributed to primary map users such as local insurance agents and .mortgage lenders; therefore, your community will serve as a repository. for these new data. We encourage you to disseminate the information reflected by this LOMR widely throughout your community in order that interested persons, such as property owners, insurance agents, and mortgage lenders, may benefit from this information. We also encourage you to consider preparing your own article for publication in the local newspaper cited earlier in this letter to describe the assistance that your community will provide in serving as a clearinghouse for these data and interpreting NFIP maps. When, in the future, a sufficient number of revisions have occurred on the affected panel, we will initiate a physical map revision to republish and distribute the panel to incorporate the changes that were made effective by letter. These changes were implemented effective October 1, 1992 and impact persons requesting revisions to NFiP maps on or after that date. The primary change involves a fee requirement for map revision and Letter of s!ap Ravission (LOMR) requests, much like the current fee requirements for conditional requests. This action is being implemented to reduce expenses to the NFIP and will contribute to maintaining the NFiP as self-supporting. Part 72.5 of the aforementioned regulations provides exemption from fees for: (a) Revisions or amendments to correct errors or to include the effects of natural changes within the areas of special flood hazard. (b) LOMRs, as determined to be appropriate by the Federal Insurance Administrator, issued to remove single residential lots or structures. from the area of special flood hazard based solely on the placement of fill outside of the regulatory floodway. The Administrator's determination shall be based, in part, on whether the LOMR is being sought by an individual property owner or whether it is being requested prior to the transfer of ownership of the property in question from a developer to an individual property owner. (c) Federal, State and local governments shall be exempt from fees for projects _they sponsor if the Administrator determines or the requesting agency certifies that the particular project is for public benefit and primarily intended for flood loss reduction to insurable structures in identified flood hazard areas which were in existence prior to commencement of construction of the flood control project. Projects undertaken primarily to protect planned flood plain development are not eligible for fee exemption. The initial fee schedule is reprinted on the reverse of this Notice. Please note that the initial fee represents the minimum engineering review and administrative processing costs associated with each type of project. These changes were implemented effective October 1, 1992 and impact persons requesting revisions to NFiP maps on or after that date. The primary change involves a fee requirement for map revision and Lettef of h4ap Revis-ion P-OMR) requests, much like the current fee requirements for conditional requests. This action is being implemented to reduce expenses to the NFIP and will contribute to maintaining the NFiP as self-supporting. Part 72.5 of the aforementioned regulations provides exemption from fees for: (a) Revisions or amendments to correct errors or to include the effects of natural changes within the areas of special flood hazard. (b) LOMRs, as determined to be appropriate by the Federal Insurance Administrator, issued to remove single residential lots or structures from the area of special flood hazard based solely on the placement of fill outside of the regulatory floodway. The Administrator's determination shall be based, in part, on whether the LOMR is being sought by an individual property owner or whether it is being requested prior to the transfer of ownership of the property in question from a developer to an individual property owner. (c) Federal, State and local governments shall be exempt from fees for projects they sponsor if the Administrator determines or the requesting agency certifies that the particular project is for public benefit and primarily intended.for flood loss reduction to insurable structures in identified flood hazard areas which were in existence prior to commencement of construction of the flood control project. In his letter, Mr. Shirazi requested that we revise the effective FIRM for the City of Pittsburg to show changes to the 100-year floodplain boundaries as a result of the installation of an eight- foot by seven-foot reinforced concrete box culvert along Lawlor Creek in the City, from .approximately 1,400 feet downstream to just upstream of Willow Pass Road. He also requested that we revise the effective FIRM for Contra Costa County to reflect the changes in the County's floodplain as a result of the installation of the box culvert. With a letter dated August 3, 1990, to Mr. Alfredo Hurtado of the City of Pittsburg Engineering Division, Mr. Robert D. Agnew, Associate Civil Engineer, Contra Costa County Flood Control and Water Conservation District, concurred with the hydraulic analysis for the box culvert. All of the data required to complete our review were submitted . with Mr. Shirazi's December 24 letter. With a letter dated January 22, 1993, from Mr. Bill Morrison, Operations Manager, Kaufman and Broad of Northern California, Inc., we received the balance of the initial fee associated with this request for a Letter of Map Revision (LOMR). A conditional LOMR was issued for this project on January 8, 1992. All fees necessary to process the LOMR, a total of $1,995, have been received. We have completed our review of the submitted data and the data used to produce the effective FIRM, and have revised the FIRM to modify the elevations and floodplain boundary delineations of a flood having a 1-percent probability of being equaled or exceeded in any given year (base flood) along Lawlor Creek. Base (100-year) flood elevations (BFEs) and the 100-year floodplain area along Lawlor Creek have decreased from just upstream to approximately 850 feet upstream of Willow Pass Road. The modifications are shown on the enclosed annotated copies of FIRM Panel 060025 0120 B, Flood Profile Panel 11P, and the Floodway Data Table for Lawlor Creek from the FIS report. This LOMR hereby revises this panel of the effective FIRM dated July 16, 1987, and this Profile Panel, and the Floodway Data Table from the FIS report dated July 16, 1987. 2 Because this revision does not involve any floodway boundary changes, we are not enclosing an annotated Flood Boundary and Floodway Map (FBFM). Unless a subsequent physical map revision involves floodway changes for FBFM Panel 060025 0120, we will not revise it to show the changes made by this LOMR. Please note that a LOMR was issued on the same date as this LOMR to revise FIRM Panel 060033 0001 D for the City of Pittsburg, to show changes to the 100-year floodplain boundaries as a result of the installation of the underground box culvert. Public notification of modifications to the BFEs along Lawlor Creek will be given in the Pittsburg Post Dispatch on or about April 21, 1993, and April 28, 1993. In addition, a Notice of Changes will be published in the Federal Register. As required by the legislation, a community must adopt and enforce floodplain management measures to ensure continued eligibility to participate in the National Flood Insurance Program (NFIP). Therefore, your community must enforce these regulations using, at a minimum, the BFEs, zone designations, and floodways in the Special Flood Hazard Areas shown on the FIRM and FBFM for your community, including the previously described modifications. This response to your request is based on minimum floodplain management criteria established under the NFIP. Your community is responsible for approving all proposed floodplain developments, including this request, and for ensuring that necessary permits required by Federal or State law have been received. With knowledge of local conditions and in the interest of safety, State and community officials may set higher standards for construction, or may limit development in floodplain areas. This LOMR will not be printed and distributed to primary map users such as local insurance agents and mortgage lenders; therefore, your community will serve as a repository for these new data. We encourage you to disseminate the information reflected by this LOMR widely throughout your community in order that interested persons, such as property owners, insurance agents, and mortgage lenders, may benefit from this information. We also encourage you to consider preparing your own article for publication in the local newspaper cited earlier in this letter to describe the assistance that your community will provide in serving as a clearinghouse for these data and interpreting NFIP maps.
