RECOMMENDED ACTION: A. DETERMINE AND FIND that the September 1991 Final Environmental Impact Report previously certified by findings' on October 8, 1991, ("previous EIR") and. the Addendum`. thereto, approved by this Board on March 23, 1993, were, are and will be considered by this Board for all approvals made on or after March 23, 1993, related to the project described in said previous EIR as modified by the Addendum. B. DETERMINE AND FIND that, together, the previous EIR and the Addendum are adequate to serve as the EIR for this project and satisfy all requirements of the California Environmental Quality Act (CEQA) . C. DETERMINE AND FIND that the Addendum, including the changes described therein, does not raise important new issues about the significant effects on the environment, but rather, clarifies, redefines, makes minor modifications, updates the information considered in the previous 1991 EIR and makes appropriate minor technical changes and.modifications to the mitigation measures made a part of the project by the previous EIR by providing for an assured, but flexible funding mechanism for possible long-term mitigation measures, the need for which will be determined by future judicial resolution. D. DETERMINE AND FIND that said funding provisions do not change the requirement to mitigate the impact of the project on the availability of a safe and dependable water supply for the residents of West Pittsburg. DETERMINE AND FIND that the purpose of including the relocation of the Madison Street water treatment plant in the.previous EIR as part of the project was as a mitigation measure to assure that the residents of West Pittsburg would have a safe and dependable water supply after the proposed acquisition and demolition of the Madison Street Water treatment plant for the project. DETERMINE AND FIND that Southern California Water Company ("SCWC") claims to be the owner and operator of the Madison Street water treatment plant. DETERMINE AND FIND that SCWC claims to operate the Madison Street water treatment plant as a backup treatment facility used to provide a backup source of treated water to residents of the Contra Costa County service area known as West Pittsburg. DETERMINE AND FIND that since the preparation of the previous EIR, that the Contra Costa Water District ("CCCWD") has undertaken to acquire the SCWC operation in its Contra Costa County service area, and that SCWC opposes the right of CCCWD to acquire its operation by eminent domain. DETERMINE AND FIND that, in the event that CCCWD acquires the SCWC Contra Costa operation, CCCWD will use its own facilities to supply treated water to residents of the West Pittsburg service area previously supplied by SCWC; and that CCCWD will not use either the Madison Street Water treatment plant or the Hill Street water treatment plant. DETERMINE AND FIND that there will be no need to provide a replacement facility for the Madison Street water treatment plant to assure the residents of West Pittsburg with a safe and reliable water source, in the event that CCCWD is successful in acquiring the SCWC operation. DETERMINE AND FIND that whether or not there will be a need to provide a replacement facility will not be known until there is a judicial resolution of the dispute between CCCWD and SCWC. F. MOVE AND ADOPT: 1 . The previous EIR as modified by said Addendum is hereby certified for this project and the findings readopted. 2 . The project described in the previous EIR as modified by the Addendum is approved. II. FINANCIAL IMPACT: There will be no impact to the County General Fund. III . REASONS FOR..RECOMMENDATIONS AND BACKGROUND: By Resolution adopted on October 8, 1991, this Board adopted a Final Environmental Impact Report (EIR) for the State Route 4/Bailey Road Interchange Improvement Project, made findings required by CEQA and determined to carry out the project described in said EIR. Changes have been made to the project described in the previous EIR. The County has authorized the preparation of an Addendum which describes the changes, previously approved by the Board on March 23, 1993. State CEQA guidelines, California Administrative Code, Title 14, Section 15164 (c) provides that the decision-making body shall consider the addendum with the final EIR prior to making a decision on the project .
