County DATE: May 17, 1993 SUBJECT: Report on Acquisition of the Contra Costa Canal by the Contra Costa Water District SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Adopt resolution supporting the acquisition of the Contra Costa Canal by the Contra Costa Water District (see Exhibit A) . FISCAL IMPACT None, directly. Indirectly, future cost savings may be achieved by eliminating the need to coordinate with federal agencies the implementation of County projects affecting the Contra Costa Canal. BACKGROUND/REASONS FOR RECOMMENDATIONS The Contra Costa Water District (District) operates and maintains the Contra Costa Canal (Canal) which is owned by the U.S. Bureau of Reclamation (Bureau) . Any local project affecting the Canal requires the review and approval of the District and the Bureau. Ownership of the Canal by the District would eliminate unnecessary bureaucracy and streamline the approval of local projects without jeopardizing water quality. The Contra Costa Water District(District)operates and maintains the Contra Costa Canal. This facility winds through a significant portion of Central and East Contra Costa County and is the principle conveyance for the District's raw water. The facility,however, is under the ownership and ultimate control of the of the United States Bureau of Reclamation (Bureau). The Contra Costa Canal was constructed by the Bureau through their Central Valley Project. Because they ultimately control the right of way, the Bureau must approve any encroachment for local road and drainage improvements. The District has provided review and coordination with local agencies on proposed improvements and has been cooperative with the various agencies in coordinating local improvement projects that involve the canal. Once agreement is reached on the scope of improvements and level of encroachment, final approval is required from the Bureau offices either in Denver or Washington, D. C. These approvals generally follow the recommendations of the District. However, this additional level of review causes delays of up to two years. Relinquishment of the Canal by the Bureau to the District would eliminate the duplication of review which is both expensive and time consuming. Ownership of the facility by the District would eliminate unnecessary bureaucracy and streamline the approval of local improvements without jeopardizing water quality. The acquisition of the right of way by the District will require Congressional action. The BOARDOF SUPERVISORS,therefore, SUPPORTS: The relinquishment of the Contra Costa Canal to the Contra Costa Water District by the United States Bureau of Reclamation.
