10K/5K Fund Raiser Race for the D.A.R.E. Program
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Authorize the County to hold harmless East Bay Municipal Utility District for the use of
the premises at Lafayette Reservoir on June 6, 1993, for a D.A.R.E. IOK/5K fund raising
race.
BACKGROUND:
The D.A.R.E. Unit is in need of funds for its Culminations, which are not covered by
the grant we received. The deputies assigned to the unit are required to make
expenditures out of their own pockets as there is not a petty cash fund. Further assets
are necessary to assist the unit in obtaining its goals.
This fund raiser also allows the public to interact with the D.A.R.E. program and
D.A.R.E. students for a better understanding of the program.
This will be the second year for this fund raiser and last year's event went extremely
well with much support from the public.
The reservoir has been reserved for the race date and arrangements for the race have
been determined.

PERMITEE: The Contra Costa Sheriff's Department D.P_.R..E: Unit
PURPOSE OF PERMIT: For the purpose of holding a 5K and 10K race
including an estimated 100 - 200 participants.
ENTRY AREA,: Lafayette Reservoir Recreation Area
TERM OF PERMIT: June 6, 1993, 8:30-11:30AM
Permission is hereby given for permittee to enter onto East Bay
Municipal Utility District land. This permission is given
subject to the following conditions:
1. Permittee will have a copy of this letter in possession while
on District land as evidence of the permission herein
granted.
2. It is understood that all board authorized rates and charges
and rules and regulations will be in full force. for
Permittee, organizers and participants and that this permit
does not grant your or your groups exclusinve use of the
recreation area,
LIABILITY FOR DAMAGES: See attached letter of self-insurance and
Hold Harmless and Indemnification.
If the above conditions are acceptable, please sign and return
the orginal copy of this permit prior to any entry . Please

9: 00 a.m. at Lafayette Reservoir Recreation Area
of the East Bay Municipal Utility District
The County of Contra Costa has been self-insured. for all
liability risks including medical. malpractice and. workers'
compensation arising from its operations, owned property,
equipment and leased. property and equipment since 1976. The
County' s self-insurance program provides for the legal defense of
officials and employees pursuant to Government Code Sec. 825 and
payment of all sums which it is obligated to pay by reason of
liability imposed by law and arising from their acts or failure
to act, excepting exemplary or punitive damages. This protection
covers services performed by officers or employees within. the
scope of their official duties. in accordance with the conditions
of their employment or services. With respect to workers'
compensation benefits, the. County provides workers' comry--sation
benefits to all of its employees and 1 E -ed by
California State Compensation laws. ��S-T \115R.

payment of claims.

Indemnification. The County shall defend, indemnify, save
and hold harmless East Bay Municipal Utility District and its
officers and employees from any and all claims, costs and
liability for any damages, sickness, death, or injury to
person(s) or property, from any cause whatsoever arising from
Contra Costa County' s activities hereunder. , save and except.
claims or litigation arising through the sole willful misconduct
of East Bay Municipal Utility District or its officers or
employees. County will make good to and reimburse. East Bay
Municipal Utility District for any expenditures, including
reasonable attorneys' fees East Bay Municipal Utility District
may make by reason of such matters and, if requested by East. Bay
Municipal Utility District, will. defend any such suits at the
sole cost and expense of the County.
