Program SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Authorize the County to hold harmless East Bay Municipal Utility District for the use of the premises at Lafayette Reservoir on June 6, 1993, for a D.A.R.E. IOK/5K fund raising race. BACKGROUND: The D.A.R.E. Unit is in need of funds for its Culminations, which are not covered by the grant we received. The deputies assigned to the unit are required to make expenditures out of their own pockets as there is not a petty cash fund. Further assets are necessary to assist the unit in obtaining its goals. This fund raiser also allows the public to interact with the D.A.R.E. program and D.A.R.E. students for a better understanding of the program. This will be the second year for this fund raiser and last year's event went extremely well with much support from the public. The reservoir has been reserved for the race date and arrangements for the race have been determined. The County' s self-insurance program provides for the legal defense of officials and employees pursuant to Government Code Sec. 825 and payment of all sums which it is obligated to pay by reason of liability imposed by law and arising from their acts or failure to act, excepting exemplary or punitive damages. This protection covers services performed by officers or employees within. the scope of their official duties. in accordance with the conditions of their employment or services. With respect to workers' compensation benefits, the. County provides workers' comry--sation benefits to all of its employees and 1 E -ed by California State Compensation laws. ��S-T \115R. The County shall defend, indemnify, save and hold harmless East Bay Municipal Utility District and its officers and employees from any and all claims, costs and liability for any damages, sickness, death, or injury to person(s) or property, from any cause whatsoever arising from Contra Costa County' s activities hereunder. , save and except. claims or litigation arising through the sole willful misconduct of East Bay Municipal Utility District or its officers or employees. County will make good to and reimburse. East Bay Municipal Utility District for any expenditures, including reasonable attorneys' fees East Bay Municipal Utility District may make by reason of such matters and, if requested by East.
