having been previously approved, Addendum No. 1 having been issued
and approved, and bids having been duly invited and received by the
Director of General Services; and
The bidder listed first above ( "RGM" ) having submitted the
lowest monetary bid; and
RGM having submitted documentation of good faith effort to
comply with the goals and requirements of the County' s Minority and
Women Business Enterprise Program and the Board having evaluated
said documentation; and
The Director of General Services recommending that the bid
submitted by RGM is the lowest responsive and responsible bid, and
this Board concurring and so finding;
NOW, THEREFORE, The Board finds, determines and orders as
follows :

ALHAMBRA AVENUE, MARTINEZ
The Board DETERMINES that RGM, as the lowest monetary
bidder, has met or exceeded the minority business enterprise goal
for this project (i.e. , 14%) and has demonstrated a good faith
effort, pursuant to the specifications for this project, to comply
with the women business enterprise goal for this project (i .e. , 6%)
and the requirements of the County' s Minority and Women Business
Enterprise Program, and the Board WAIVES any irregularities in such
compliance; and
The Board ORDERS that the contract for the furnishing of
labor and materials for said work is awarded to RGM at the listed
amount and at the prices submitted in said bid, and that said
contractor shall present two good and sufficient surety bonds as
indicated above; and that the General Services Department shall
prepare the contract therefor; and
The Board FURTHER ORDERS that after the contractor has signed
the contract and returned it, together with the bonds as noted
above and any required certificates of insurance or other required
documents, and the Director of General Services has reviewed and
found them to be sufficient, the Director of General Services is
authorized to sign the contract for this Board; and
The Board FURTHER ORDERS that in accordance with the
project specifications and/or upon signature of the contract by the
Director of General Services, any bid bonds posted by the bidders
are to be exonerated and any checks or cash submitted for security
shall be returned; and
The Board FURTHER ORDERS that the Director of General
Services is authorized to sign any escrow agreements prepared for
this project to permit the substitution of securities for moneys
withheld by the County to ensure performance under the contract,
pursuant to Section 22300 of the Public Contract Code; and
Pursuant to Public Contract Code Section 4114, the Board
DELEGATES its functions under Public Contract Code Sections 4107
and 4110 to the Director of General Services. or his designee; and
The Board DECLARES that, should the award of the contract
to RGM be invalidated for any reason, the Board would not in any
event have awarded the contract to the second listed bidder or any
other bidder, but instead would have exercised its discretion to
reject all of the bids received. Nothing herein shall prevent the
Board from reawarding the contract to another bidder in cases where
the successful bidder establishes a mistake, refuses to sign the
contract or fails to furnish required bonds or insurance (see
Public Contract Code Sections 5100-5107) .

Architectural Division Offices on Thursday, April 8, 1993.
,It is recommended that the Board of Supervisors award the construction
contract to the low bidder, RGM and Associates, Inc.. of Concord, in the amount
of $353,400.00, base bid only.
The Consultant's estimate was $310,000.00 Base Bid Only.

.Dear Sirs:
Please find attached various documents in support of our pursuance of the MBEIWBE goals.
Also, a structured narrative regarding "Good Faith Effort" and additional comments.
PART 1 - MBEIWBE GOALS
A. MBE GOAL REQUIRED 14% ACHIEVED 17.9%

Kelly-Son & Associates has worked with us for many years. Primarily with Fire Protection work,
but they also possess a B license and on this particular project has successfully bid the framing
and-general:demolition portions of the work as well. They are currently certified with Contra
Costa County.
B. WBE GOAL REQUIRED 6% ACHIEVED. 6.3%
Gosnell Doors was the low bidder on doors, frames and hardware at $10,676. As a supplier we
used their amount at 60% which was $6,406. They are certified with the City of Oakland.
S&K Nellis Paint came in at $9,410. They were not low but we elected to use them because of
their certified WBE status. They are certified with Contra Costa County.
Anderson Carpets bid was $6,893 and again was not low but we used them anyway. I relied
upon their statement in good faith but it turned out 1 was misinformed by their salesperson
regarding their certification status with the City of Oakland which turned out not to be the case.
They are however certified with Cal Trans and the University of California. We have submitted a
full body of documentation in support of their WBE status but as of this time they seem not to
be certified with the County. RGM & Associates would like to make an appeal to accept this firm
based on the documented evidence or at least hold off on any final decision regarding award of
this contract until their acceptability can be determined one way or the other, or allow us the
opportunity to substitute. Once again,.in a committed effort to meet the required goals we
accepted and used bids we knew were not low and were mislead as to the status.of this firm
wtih the County.

PART 2 - GOOD FAITH EFFORT (BASED ON DIVISION E FORMAT)
A. Regarding the Pre-Bid Meeting, I personally attended the meeting for this project which took
place on March 24, 1993 at 2:00 PM.
B. All divisions of this project including demolition, concrete, framing, cabinets, doors,
windows, drywall, flooring, acoustic ceiling, painting, stucco, plumbing, HVAC and electrical
were actively solicited from all identified.MBEIWBE/DVBE's in RGM's extensive database of
these companies which currently numbers about 120. RGM &Associates actively and routinely
solicits MBE/WBEIDVBE's on all projects it is bidding whether it is required or not as a matter of
policy.
You will find enclosed a copy of the MBEIWBEIDVBE list of all solicited companies.and
organizations along with a copy of our company newsletter announcing upcoming projects and
specifically this particular project.
C. There is enclosed a copy of an ad placed in "The Entrepreneur" on March 24, 1993. This
newsletter is published by United Minority Business Entrepreneurs Inc. (UMBE) and specifically
targets the minority subcontracting community.
D. No certified letters were sent.
E. Followup phone calls were made to:

G. I personally visited Emma Kuevor in her office to seek assistance and purchase the County's
directory of certified MBEIWBE's. No certifiedletters were sent.
H.• The only bid not to be utilized from a certified MBE was Royal Flush Plumbing (Mike Gomez
510-689-4467) who's bid ($35,000) 1 felt was too high based on the majority of other bids 1
received. I discussed the matter with him and he refused to reconsider his bid. I had strong
reason to believe that if I accepted his bid I would lose the project so I couldn't accept it. I
ended up listing Pope Plumbing ($29,000).
I. At this time no assistance regarding bonds, insurance or lines of credit has been requested.
In the event any are, RGM will do it's utmost to assist and assure success.
