SUBJECT: INCREASE AND/OR ESTABLISH VARIOUS FEES IN THE DEPARTMENTS OF THE
COUNTY CLERK, ANIMAL SERVICES, SHERIFF-CORONER AND PROBATION
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
1. FIX Tuesday, June 15, 1993 at 11:00 a.m. for a public hearing on the increase and/or
establishment of various fees in the departments of the County Clerk, Animal
Services, Sheriff-Coroner and Probation.
2. DIRECT the Clerk of the Board to publish required notices; DIRECT departments to
submit to the Clerk of the Board by Monday, May 31, 1993 documentation
supporting the fee increases to be made available to the public for inspection.
FINANCIAL IMPACT:
Increased revenues expected from the fee adjustments are already included in the
departments' budget plans for FY 1993-94 and will, therefore, not result in new financing
for program enhancements or mitigation of proposed program reductions.
BACKGROUND:
Existing law permits the County to charge fees not exceeding the actual cost of providing
certain services. On April 20, 22 and 30, 1993, the Board accepted the County
"Administrator's report and recommendations on "local problem" and 40% reduction plans
and heard testimony from departments, staff and concerned citizens on proposed budget
reductions. Some department reduction - plans included proposed fee increases in their
reduction proposals.

Existing law requires that a public hearing be held at which oral or written presentations can
be made prior to a county adopting any legislation enacting a new or increased fee. This
meeting must also be noticed in a regularly published newspaper.
CONSEQUENCES OF NEGATIVE ACTION:
Failure to increase and/or adopt the proposed fees would require additional. program
reductions for the affected departments.

Upon further consideration and examination of Section 1203 . 1b PC,
I 've concluded that we can increase the maximum fee without any
need to modify the existing County Ordinance 62-8 adopted in 1989 .
The ordinance does not speak to a specific fee amount and needn ' t
specify any change .
County Counsel has confirmed that we can raise the maximum fee
amount with approval of the Court without any changes needed in
the existing ordinance.
Judge Swager has approved my recommendation to raise the monthly
maximum fee to $50 . 00 . See attached.
I 'm not sure how your office wishes to deal with this in regard to
agenda item on fees June 15th. Perhaps in an informational way to
the Board. As far as we ' re concerned, the new maximum fee is now
operative.

It is imperative that the Probation Department maximize revenues
from cost of probation payments if we are to continue to provide
these services .
We last set the fee at S25/month maximum even though actual
average costs were approximately 540/month when the first
ordinance was adopted in April , 1989 . Much has changed since
that time and our costs of operation have risen. We have
attached a copy of our cost calculation. A weighted average
between the "banked" cases and actively supervised cases is
554 . 87 .
While we are proposing a maximum fee of 550/month, we expect
several probationers on inactive supervision will be assessed a
monthly fee closer to 525/month.
If the proposed ordinance meets with your approval , please sian
this memo, . return it to me and I will initiate the needed Board
ordinance .

RECOMMENDATION:
Approve increase in maximum cost of probation fee to $50 per month.
BACKGROUND:
Assessment of a monthly fee based on cost was authorized by County
Ordinance April 25, 1989 . A maximum fee was thereafter set at
$25 . 00 per month. Costs have increased since that time and the
adjustment is consistent with actual average costs at this time.
AUTHORITY:
Section 1203 . 1b CPC authorizes fees for probation supervision as
approved by the County Board of Supervisors . Statutes require the
Superior Court to approve the schedule of reimbursement not to
exceed actual average cost. The Court may, after determination of
ability to pay, order a defendant to pay all or a portion of the
reasonable costs of probation. The Court shall order monthly
payments as directed by the probation officer. Execution of the
Court ' s order shall be in the same manner as a judgment in a civil
action and shall not be enforced by contempt. The provisions of
this statute shall be operative upon adoption of an ordinance by
the Board of Supervisors .
FEE SCHEDULE DETERMINATION:
Calculation of costs is based on the costs for deputy probation
officers, clerks and supervisors assigned the function of probation
supervision. Services and supplies costs and overhead at . 1302 for
the Department and . 1183 for the County were added. The total cost
of supervision is $155,556 per month. This was divided by the
number of probationers under supervision, arriving at an average of
$54 . 87 per probationer.
EXECUTION AND- ENFORCEMENT:
Probation fees are recommended by the probation officer in all
cases wherein supervised probation is anticipated. Probationers
ordered to pay costs are "billed" on a monthly basis by the Office
of Revenue . Collection. Actual payment per month is assessed by
either the sentencing judge or the probation officer if so
authorized.
Arrearages due may be enforced civilly, including interception of
State income tax refunds .
