Transportation Commission (MTC) for 3% Reserve Bridge Toll Revenues to fund a share of staff services provided by County staff to the Greater East Bay Rail Opportunities Coalition. FISCAL IMPACT 3% Reserve Program Funds could be used in lieu of some County Road Funds currently budgeted for this project. BACKGROUND/REASONS FOR RECOMMENDATIONS Regional Measure I (November, 1988) created new revenues for allocation by the MTC. Among these funds is the 113% Reserve Funds" . which refer to three percent of the revenues from the 1989 toll increase in the northern and southern bridge groups. These funds are available to public entities for planning, operating, and capital projects which are designed to reduce vehicular traffic on state-owned bridges in the region. At the present time, County staff activities in support of the Greater East Bay Rail Opportunities Coalition are paid mainly from the County Road Fund. As these activities might be eligible for funding under the 3% Reserve Fund Bridge Toll Program, the Community Development Department proposes to submit an application to the MTC under this program to fund a portion of staff services now provided by the Community Development Departmengtcto upport the Greater East Bay Rail Opportunities Coalition. Adoption of a Board Resolution and an opinion by legal counsel (see sample attached as Exhibit B) that the County is an eligible applicant are required by the MTC when submitting an application for these funds. 5 E H I B I T A THE BOARD OF .SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 11, 1993 , by the following vote: AYES: Supervisors Powers, Smith, Bishop, Weak, Torlakson NOES: None ABSENT: None ABSTAIN: None Resolution No. 93/224 SUBJECT: Application under the Regional Measure I 3% Reserve Bridge Toll Program The Board of Supervisors of Contra Costa County RESOLVE: WHEREAS, with a toll increase authorized by Regional Measure I approved by the voters on November 8, 1989 (hereinafter Regional Measure I) , 3% of the revenue for the toll increase collected on all the state-owned bridges in the region has been reserved for allocation by the Metropolitan Transportation Commission for certain projects which are designed to reduce vehicular traffic congestion on these bridges; and, WHEREAS, the Metropolitan Transportation Commission (MTC) has established a programming and allocation policy to guide its review of applications for the allocation of these bridge toll revenues; and, these guidelines permit public entities to submit applications for eligible projects. WHEREAS, the Metropolitan Transportation Commission may allocate funds to public entities for transportation projects which are designed to reduce vehicular traffic on any state-owned bridge in the region, including the planning of these transportation projects; and, WHEREAS, the County of Contra Costa has joined with Alameda and Solano counties through a Joint Exercise of Powers Agreement to form the Greater East Bay Rail Opportunities Coalition for the purpose of advancing a staged rail development program for the East Bay, which when implemented will reduce vehicular traffic on state- owned bridges; and, WHEREAS, no source of funds is dedicated for the staffing of the Greater East Bay Rail Opportunities Coalition; and, WHEREAS, Petroleum Violation Escrow Account (PVEA) grant funds to Contra Costa County currently used for planning studies for the three county effort cannot be used to support administration of Greater East Bay Rail Oppourtunities Coalition; and, WHEREAS, funding for staff services provided by Contra Costa County to the Greater Bay Rail Opportunities Coalition fall within the definition of eligible projects under the 3% Reserve Bridge Toll Revenues guidelines established by the Metropolitan Transportation Commission; RESOLUTION NO. 93/224 NOW THEREFORE, the Board of Supervisors of Contra Costa County does hereby authorize the Director of Community Development to submit an application to the Metropolitan Transportation Commission for 3% Reserve Bridge Toll Revenues to fund a share of staff services provided by County staff to the Greater East Bay Rail Opportunities Coalition. 1 hereby certify that the foregoing is a true and correct copy of an order entered on the minutes of the Board of Supervisors of the date aforesaid. Administrator by: e, Deputy Clerk 3%res. 1 Oriq.Dept. :CDD/TP RESOLUTION NO. 93/224 /i %A Ex6;+ L� OPINION OF COUNSEL (Recommended Format) To: Metropolitan Transportation Commission From: (Applicant) Date: RE: Eligibility for Allocation of Bridge Toll Net Revenue "Three Percent Reserve" Funds" This communication will serve as the requisite opinion of counsel in connection with the application of ( Applicant ) for an allocation of Bridge Toll net Revenue "Three Percent Reserve" funds, made available pursuant to Streets and Highways Code Sections 30892, 30893, `30913 and 30914. 1 . (_ Applicant ) is authorized to carry out the activities - associated with the project for which an allocation of funds is requested. 2. ( Applicant ) is an eligible applicant for Bridge Toll Net Revenues "Three Percent Reserve" funds in accordance with the provisions of Streets and Highways Code Section 30892, 30893, 30913 and 30914. 3. I have reviewed the pertinent state and local laws and I am of the opinion that here is no legal impediment to ( Applicant ) making applications for Bridge Toll Net Revenues, "Three Percent Reserve" funds. Furthermore, as a result of my examinations, I have determined that there is. no pending or threatened litigation which might in any way adversely affect the proposed projects, or the ability of ( Applicant ) to carry out such projects.
