SUBJECT: CHANGE OF ELECTION DATE FOR TOWN OF MORAGA
The Board received the request from the Town of Moraga to change their
Municipal election from June of even years to November of even years.
There will be no difference in the billing process since both elections are
statewide.
The Board hereby approves the change of election date.

Enclosed is a copy of Ordinance 147, An Ordinance of
the Town of Moraga, Establishing General Municipal
Elections on the Same Date as the Statewide General
Election Date in November of Even Numbered Years .
This Ordinance was adopted by the Moraga Town Council
on February 10, 1993 . The Town Council wishes to change
its election dates from June of even numbered years, to
November of even numbered years, in order to conform to the
majority of cities within the County. ' Participation in
Countywide activities such as the Mayors' Conference, CCTA,
and other important activities, will be enhanced by the
change, allowing our Councilmembers to rotate to the
various appointments at the same time as other cities .
Under Government Code Section 36503 . 5 (a) ( 1) , the
Board of Supervisors must approve this proposed change,
prior to the ordinance becoming operative. We ask that the
Board make such approval at their convenience. Once we are
given notice of such approval, the Town is ready to notify
all of the registered voters of the change, in accordance
with Government Code 36503 .5 (e) .

BEFORE THE TOWN COUNCIL OF THE TOWN OF MORAGA
In the Matter of:

The Town Councii of the Town of Moraga DOES ORDAIN as
follows :
Section 1 . Title 2 (Administration) of the Moraga
Municipal Code is amended to read as follows :
"CHAPTER 2-5
GENERAL MUNICIPAL ELECTIONS
Sections :
2-501 . Date of Election
2-502 . Expiration of terms of office
2-503 . Conduct of Succeeding General Municipal Elections
2-501 Date of Election
The General Municipal Election for the Town of Moraga
shall be held on the same day as the Statewide General
Election on the first Tuesday after the first Monday in
November of each even-numbered year, beginning with the
election to be held November 1994 . (Reference: Elections

2-502 Expiration of Terms of Office
Under section 36503 .5 of Governmental Code, those
elected Councilmembers whose terms of office would have,
prior to adoption of this Ordinance, expired on the date of
the first Council meeting following certification of vote
cast at the first Tuesday after the first Monday of June
1994 , shall have their terms of office increased and shall
continue in office until no later than the first regular
meeting of the Town Council following certification of
General Election results in November of 1994 and 1996 ,
respectively, and until their successors are elected and
qualified.
2-503 Conduct of Succeeding General Municipal
Elections
The Municipal General Election in 1994 , and each
Municipal General Election thereafter, shall be conducted
on the date specified by this chapter, in accordance with
Section 36503 . 5 of the Government Code, unless this chapter
is later repealed by the Town Council . "
Section 2 . Transmittal to Board of Supervisors .
The Town Clerk is directed to transmit a certified
copy of this Ordinance to the Contra Costa County Board of
Supervisors, requesting approval of the consolidation.
Section 3 . Effective Date.
This Ordinance becomes effective 30 days after its
adoption and becomes operative after its approval by the
Contra Costa County Board of Supervisors .
Section 4 . Notice to Registered Voters .
Within thirty (30) days after this chapter becomes
operational under Section 3, the Town Clerk shall cause a
notice to be mailed to all registered voters informing the
voters of the change in the election date. The notice
shall also inform voters that, as a result of the change in
the election date, elected Town officeholder' s terms in
office will be lengthened.
Section. 5 . Publication.
The Town Clerk shall either a) . have this Ordinance
published once within 15 days after adoption in a newspaper
of general circulation, or b) have a summary of this
Ordinance published twice in a newspaper of general
circulation, once five days before its adoption, and again
within 15 days after adoption.
The foregoing Ordinance was introduced at a meeting of
the Town Council of the Town of Moraga on January 27 , 1993,
and was adopted by the Town Council on February 10, 1993,
by the following vote:
AYES : Mayor Susan L. Noe, Vice Mayor Al
Dessayer, Councilmember Cherie T. Grant,
Councilmember Michael G. Harris, and
Councilmember James J. Sweeny
