BE IT RESOLVED that the Board of Supervisors of Contra Costa County
APPROVES the side letter (copy attached and included as part of
this document) , jointly signed by Richard Heyne, Employee Relations
Manager, and Anne Mueller, Business Representative, Contra Costa
County Employees ' Association, Local 1, regarding a one-time-only
lump sum payment to employees in the Child Development Unit for the
1991 - 1992 educational contract year between the California State
Department of Education and the Contra Costa County Community
Services Department.

Dear Ms. Mueller:
This Side Letter memorializes agreement between the parties
for a one-time-only, lump sum, cost of living payment to eligible
permanent and temporary project employees in the Child'Development
Program of the Community Services Department.
It is understood and agreed by the parties that this one-time-
only, lump sum cost of living payment in no way sets a precedent
for the allocation of monies in future fiscal contract years
between the State of California and the Contra Costa County
Community Services Department.
Lump sum cost of living payments will be made to eligible
employees in accordance with the following criteria:
1. Eligibility is based on employment earnings history in
the Child Development Program from July 1, 1991, through June
25, 1992, and currently employed by the Community Services
Department as of November 30, 1992 (see Attachments "A" and
"B" ) .
2 . The amount of lump sum, cost of living payment for each
employee will be calculated by first dividing an employee's
July 1, 1991, through June 25, 1992, employment earnings by
the total Child Development Division payroll for the same time
period to arrive at a percent. For purposes of illustration
only, the following formula is shown:

3. The percentage derived by the formula shown in paragraph
two (2) above will then be multiplied by $37,687 .00, the total
lump sum dollar figure available to the Community Services
Department. For purposes of illustration only the following
formula is shown:
Percent (%) x lump sum dollars = employees lump sum pay .

4 . The payment amount computed will be issued as soon as
possible by the County Auditor-Controller shown on an
employee' s regular 10th of the month pay check as a Lump Sum
Payment, subject to normal tax withholding deduction require- `
ments .
Any employee believing there is an underpayment resulting from
the payment methodology described above, may contact the
Community Services Department's Personnel Officer to request
a review of her/his lump sum payment. Upon such a request,
the Auditor's Office will investigate and issue any additional
pay, if owed, as soon as possible..
If the foregoing conforms to your understanding, please
indicate your approval and acceptance in the space provided below.

WHEREAS the Community Services Director has advised the Office
of the County Administrator that the California State Department of
Education has allowed surplus funds approximating thirty-seven
thousand six hundred eighty-seven dollars from the 1991-1992
Community Services Child Development Program budget to be used for
a one-time-only lump sum payment to eligible management and
represented employees, NOW THEREFORE,
The Contra Costa County Board of Supervisors in its capacity
as governing Board of the County of Contra Costa, and all districts
of which it is the ex-officio governing Board, RESOLVES THAT:
A one-time-only lump sum payment will be made to the following
management and represented employees in accordance with the detail
described below:
