SUBJECT: Continued for Decision the Hearings on Development Agreements between
Contra Costa County and Windemere Ranch Partners and Shapell Industries
and Preliminary Development Plans 2992-RZ and 2993-RZ in the Dougherty
Valley Area.

RECOMMENDATIONS
1. Continue the decisions on the rezoning/preliminary development
plans 2992-RZ and 2993-RZ and the development agreements to
June 8 , 1993 .

BACKGROUND/REASONS FOR RECOMMENDATIONS
This matter was continued from April 6, 1993 to April. 27 , 1993 at
the Board's request.
On February 23 , 1993 the Board of Supervisors met to consider
further the applications for development agreements and preliminary
development plans for the Dougherty Valley. Pursuant to staff's
recommendation, the Board continued its consideration to April 6,
1993 and directed staff to explore the possibilities for continued
informal public participation to discuss the development agreements
and the preliminary development plan applications.

Staff has evaluated carefully the allegations in the litigation
concerning the EIR and General Plan Amendment and Specific Plan
approvals for Dougherty Valley. Based on that analysis, staff is
confident that further processing for the Dougherty Valley or a
portion thereof, can move forward if that is the Board's desire.
Staff is discussing with the applicants possibilities for further
processing, including modifications to the draft development
agreements and preliminary development plans. Any recommendation
on the applications would be premature at this stage. In addition,
Shapell has submitted revised applications for a� vesting tentative
map, preliminary development plan and final development plan for
Coyote Creek.
On March 3 , 1993 petitioners, respondents and real parties in
interest in the Dougherty Valley litigation held a CEQA-mandated
settlement meeting.
Staff, therefore, recommends that the Board continue its
consideration of the rezoning/preliminary development plans and
development agreements to June 8 , 1993 . In the meantime,
discussions relating to the Board's December 22 , 1992 decisions
should continue according to (and should be limited to)- the process
established under CEQA.
