APPROVE the transfer of the more than 2,300 formal probation fine and victim restitution accounts from the Office of Revenue Collection (ORC) to the Municipal Courts effective May 1, 1993. 2. ESTABLISH the class of Municipal Court Collection Agent, allocate it to the Basic/Exempt Salary Schedule; CANCEL two vacant Deputy Clerk-Experienced Level positions (C7-56 and C7-193) and ADD two Municipal Court Collection Agent positions. 3. Acknowledge continued support for a central County collection agency. FINANCIAL IMPACT: No additional County cost is associated with this proposal. Costs of the higher-level positions will. be offset by the elimination of two vacant positions, the downgrade of a vacant District Court Manager position and increased revenues, all of which are in the Municipal Courts' budget. The transfer of responsibility for the formal probation fine and victim restitution accounts will have no impact on staffing at ORC and may, in fact, allow existing staff to devote more resources to accounts for which ORC can fully recover its costs. No layoffs will occur as a result of position conversions in the Municipal Courts because the positions to be converted are currently vacant. continued... The Finance Committee considered the report of the County Administrator on April 12, 1993 and heard testimony from representatives from the Municipal Courts, ORC and interested employee organizations. After accepting the Administrator's report and hearing testimony, the Committee concluded that although the concept of centralized collections has proven to be cost-effective and should receive continued support, the County Administrator's proposal to transfer specific accounts to the Municipal Courts is unique in that it is encouraged by trial court funding legislation and ties into an overall efficiency plan being implemented by the Courts. On the basis of this rationale, the Finance Committee recommends support by the Board for the proposal to transfer formal probation fine and restitution accounts from ORC to the Municipal Courts. CONSEQUENCE OF NEGATIVE ACTION: Should the recommendations to transfer formal probation and victim restitution accounts to the Municipal Courts not be approved, the Municipal Courts would have no choice but to require the Office of Revenue Collection to begin aggressive collection activity on all accounts at additional cost to the County. It would also undermine the judges' ability to effectively monitor defendant compliance with all conditions of probation and would be in direct conflict with the judges responsibility to assume control of their mandated functions.
