SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Defer consideration of disposal of Pine Creek Basin Property for at least 12
months and relist item for the Finance Committee Agenda for April, 1994.
2. Direct the Director of the Growth Management and Economic Development
Agency to discuss potential plans for the property with officials from the City of
Walnut Creek.
3. Direct GMEDA to process a tentative map for the property.
BACKGROUND:
On March 16, 1993, it was recommended by the Board of Supervisors that the timing of
sale for Pine Creek Detention Basin Surplus Property be reviewed by the Finance
Committee in consideration of the following issues:
1. Receipt of revenue versus State reimbursement for other projects
2. Completion of Wildcat-San Pablo Creek Project
3. Appraisal value versus current market value
4. Speed with which the property can be put on the market

On April 12, the Committee was presented a report by the Director of Growth
Management and Economic Development Agency. Also, Mitch Jenkins, an interested
party, offered testimony on the property. The Committee determined that it would be in
the best interest of the-County to delay consideration of disposing of the property for at
least a year due to uncertainties in the real estate market and with State reimbursement
to the County for other public works projects.
The Committee suggested that in the interim, the Director of GMEDA discuss the matter
with Walnut Creek officials and begin to process a tentative map. The Committee
recommendations include reconsidering this item in April, 1994.

1. Recommended Action:
1. ACCEPT this report from the Chief Engineer regarding the ultimate disposal of the Pine
Creek Detention Basin.,,Surplus Property, and
2. REFER item to the Finance Committee for review and recommendation.
11. Financiallmpact:
The surplus property has an estimated value of $5,950,000 based on an outside appraisal
completed in 1991. The State of California is entitled to approximately 75 percent of the sale
proceeds. The State owes the District approximately $1,740;000 for outstanding reimbur-
sement claims. Additional claims of $1,100,000 will be submitted with the last two contracts
on Wildcat-San Pablo Creeks.
III. Reasons for Recommendations and Background:
The surplus property is approximately 39 acres in area and immediately adjacent to the Pine
Creek Detention Basin. In constructing the detention basin, approximately 700,000 cubic
yards of basin excavation material was placed and compacted on the surplus property as a
means of mitigating the traffic impact that would have .resulted from hauling the surplus
material elsewhere.

When the surplus property was purchased, it did not have domestic water, and it was Zoned
A2. Since then, the Flood Control District has secured domestic water through Contra Costa
Water District, and the City of Walnut Creek and the County have completed a specific plan
study for the Northgate area which specifies an R-40 zoning for the surplus property. As a
part of the specific plan process, in June 1991, the City of Walnut Creek requested that the
site not be developed or sold for two years to give them time to decide if they wanted to
purchase the property for open space.
The State of California reimbursed the District 75 percent of the purchase price for the
property in 1979. Consequently, when the property is sold, 75 percent of the sale prices,
after subtracting the Districts cost for domestic water, will have to be returned to the State.
The State currently owes the District $1,740,000 in outstanding reimbursements. With the
States current funding crisis, it does not appear that they will fund the federal flood control .
program reimbursements in the near future. Also the District will be incurring additional State
reimbursable costs during the next two years in completing the Wildcat-San Pablo Creeks
project. Consequently, our only guarantee that we will receive the monies owed by the State
is for the District to retain said amounts from any refunds we might owe them.
