ACKNOWLEDGE that the Board of Supervisors is the SPONSOR of AB 1904 by Assemblyman Campbell, which would authorize the Board of Supervisors in Contra Costa County to establish an assessment district and impose a benefit assessment for library services . 2 . REQUEST Assemblyman Campbell to amend AB 1904 to delete the 5% protest requirement and instead require a majority vote of the people in support of the benefit assessment in order to made it possible for the Board of Supervisors to impose the assessment. 3 . REQUEST Assemblyman Campbell to amend AB 1904 to add "intent" language which indicates that the benefit assessment authority is intended to be for local option programs, not to replace state or federal funds which may have been withdrawn. 4 . REQUEST the County Administrator to ask Senator David Roberti to amend hiS ,SB 566 to likewise require a vote of the people, rather than requiring the protest process . 5 . DECLARE the Board' s intent, if AB 1904 and SB 566 are both enacted into law and if SB 566 does not require a vote of the people, to utilize only AB 1904, since it does require a vote of the people. DIRECT the County Librarian to contact the County Library Commission, Friends of the Library groups and other organizations which might be supportive of this legislation and ask that they send letters of support to Assemblyman Campbell and the Board of Supervisors . BACKGROUND: The Board's 1993 Legislative Program includes the following proposal : 35 . Seek authority to impose a benefit assessment for law enforcement and library services . - Sponsor legislation which would provide Contra Costa County and its cities the authority to impose a benefit assessment for law enforcement services and the County the authority to impose a benefit assessment for library services . Currently the County has the authority to impose a benefit assessment for several types of services, such as fire service. With the severe budget cuts which are anticipated from the 1993-94 State Budget, unacceptable reductions will have to be made in law enforcement and library services . Legislation was recommended which would provide the Board of Supervisors with the authority to impose a benefit assessment for library services, following a noticed hearing and an opportunity for a protest. The legislation is closely patterned after existing fire suppression assessment legislation. Assemblyman Campbell has introduced AB 1904 at the request of the Board of Supervisors to implement the library portion of this item. Other legislation has been introduced this year to increase the protest trigger figure from 5% to 10% . Assemblyman Campbell may want to suggest that this bill be amended to raise the protest figure to 10% if it appears that the other legislation will be enacted. This bill has been made specific to Contra Costa County. In addition, the Board may wish to simply drop the protest provisions and require a majority vote of the public in order to make the benefit assessment effective. ACKNOWLEDGE that the Board of Supervisors is the SPONSOR of AB 1905 by Assemblyman Campbell, which would authorize the Board of Supervisors in Contra Costa County and the City Council of any city in Contra Costa County to establish an assessment district and 'impose a benefit assessment for law enforcement services . 2 . REQUEST Assemblyman Campbell to amend. AB 1905 to include the Kensington Community Services District as a jurisdiction which could impose a benefit assessment for law enforcement services. 3 . REQUEST Assemblyman Campbell to amend AB 1905 to delete the 5% protest requirement and instead require a majority vote of the people in support of the benefit assessment in order to made it possible for the Board of Supervisors to impose the assessment. 4 . REQUEST Assemblyman Campbell to amend AB 1905 to add "intent" language which indicates that the benefit assessment authority is intended to be for local option programs, not to replace state or federal funds which may have been withdrawn. 5 . REQUEST the ' County Administrator to contact the District Attorney and Sheriff-Coroner, explain the changes being made to the bill : by the -Board of Supervisors and request their ongoing support for the bill and that they attempt to elicit the support of other law enforcement organizations which might be willing to send letters to Assemblyman Campbell supporting the legislation.
